1515 RELATING TO INSURANCE -- ACCIDENT AND SICKNESS INSURANCE POLICIES

2222 It is enacted by the General Assembly as follows:
2323 SECTION 1. Chapter 27-18 of the General Laws entitled "Accident and Sickness Insurance 1
2424 Policies" is hereby amended by adding thereto the following section: 2
2525 27-18-68.1. Mandatory coverage for scalp cooling systems. 3
2626 (a) Every individual or group hospital or medical expense insurance policy or individual 4
2727 or group hospital or medical services plan contract delivered, issued for delivery, or renewed in this 5
2828 state on or after January 1, 2026, shall provide coverage to individuals diagnosed with breast cancer 6
2929 and undergoing chemotherapy treatments for scalp cooling systems to preserve hair during 7
3030 chemotherapy treatments. 8
3131 (b) This section shall not apply to insurance coverage providing benefits for: 9
3232 (1) Hospital confinement indemnity; 10
3333 (2) Disability income; 11
3434 (3) Accident only; 12
3535 (4) Long-term care; 13
3636 (5) Medicare supplement; 14
3737 (6) Limited benefit health; 15
3838 (7) Specified disease indemnity; 16
3939 (8) Sickness or bodily injury or death by accident or both; and 17
4040 (9) Other limited benefit policies. 18
4141 SECTION 2. Chapter 27-19 of the General Laws entitled "Nonprofit Hospital Service 19

4545 Corporations" is hereby amended by adding thereto the following section: 1
4646 27-19-59.1. Mandatory coverage for scalp cooling systems. 2
4747 (a) Every individual or group hospital or medical expense insurance policy or individual 3
4848 or group hospital or medical services plan contract delivered, issued for delivery, or renewed in this 4
4949 state on or after January 1, 2026, shall provide coverage to individuals diagnosed with breast cancer 5
5050 and undergoing chemotherapy treatments for scalp cooling systems to preserve hair during 6
5151 chemotherapy treatments. 7
5252 (b) This section shall not apply to insurance coverage providing benefits for: 8
5353 (1) Hospital confinement indemnity; 9
5454 (2) Disability income; 10
5555 (3) Accident only; 11
5656 (4) Long-term care; 12
5757 (5) Medicare supplement; 13
5858 (6) Limited benefit health; 14

6262 SECTION 3. Chapter 27-20 of the General Laws entitled "Nonprofit Medical Service 18
6363 Corporations" is hereby amended by adding thereto the following section: 19
6464 27-20-54.1. Mandatory coverage for scalp cooling systems. 20
6565 (a) Every individual or group hospital or medical expense insurance policy or individual 21
6666 or group hospital or medical services plan contract delivered, issued for delivery, or renewed in this 22
6767 state on or after January 1, 2026, shall provide coverage to individuals diagnosed with breast cancer 23
6868 and undergoing chemotherapy treatments for scalp cooling systems to preserve hair during 24
6969 chemotherapy treatments. 25
7070 (b) This section shall not apply to insurance coverage providing benefits for: 26
7171 (1) Hospital confinement indemnity; 27
7272 (2) Disability income; 28
7373 (3) Accident only; 29
7474 (4) Long-term care; 30
7575 (5) Medicare supplement; 31

8383 SECTION 4. Chapter 27-41 of the General Laws entitled "Health Maintenance 2
8484 Organizations" is hereby amended by adding thereto the following section: 3
8585 27-41-71.1. Mandatory coverage for scalp cooling systems. 4
8686 (a) Every individual or group hospital or medical expense insurance policy or individual 5
8787 or group hospital or medical services plan contract delivered, issued for delivery, or renewed in this 6
8888 state on or after January 1, 2026, shall provide coverage to individuals diagnosed with breast cancer 7
8989 and undergoing chemotherapy treatments for scalp cooling systems to preserve hair during 8
9090 chemotherapy treatments. 9
9191 (b) This section shall not apply to insurance coverage providing benefits for: 10
