| 21 | 21 | | It is enacted by the General Assembly as follows: |

| 22 | 22 | | SECTION 1. Chapter 45-53 of the General Laws entitled "Low and Moderate Income 1 |

| 23 | 23 | | Housing" is hereby amended by adding thereto the following section: 2 |

| 24 | 24 | | 45-53-17. Well testing for private or public wells in the town of Tiverton. 3 |
|---|
| 25 | 25 | | (a) For any private or public well requirement within the town of Tiverton, the town may 4 |
|---|
| 26 | 26 | | require additional testing to be performed by the developer, to ensure that any well within close 5 |
|---|
| 27 | 27 | | proximity of the construction site will not be affected by dewatering or the loss of effective 6 |
|---|
| 28 | 28 | | recharge. This condition shall be satisfied prior to the commencement of construction on any low- 7 |
|---|
| 29 | 29 | | or moderate- income housing under this chapter. 8 |
|---|
| 30 | 30 | | (b) The testing shall comply with all regulations issued by the department of environmental 9 |
|---|
| 31 | 31 | | management and the department of health. 10 |
|---|
| 32 | 32 | | (c) The department of environmental management may issue rules and regulations to 11 |
|---|
| 33 | 33 | | promulgate the requirements of this section. 12 |
|---|
