23 | 23 | | It is enacted by the General Assembly as follows: |
---|
24 | 24 | | SECTION 1. Section 39-26-5 of the General Laws in Chapter 39-26 entitled "Renewable 1 |

25 | 25 | | Energy Standard" is hereby amended to read as follows: 2 |
---|
26 | 26 | | 39-26-5. Renewable energy resources. 3 |
---|
27 | 27 | | (a) Renewable energy resources are: 4 |
---|
28 | 28 | | (1) Direct solar radiation; 5 |
---|
29 | 29 | | (2) The wind; 6 |
---|
30 | 30 | | (3) Movement or the latent heat of the ocean; 7 |
---|
31 | 31 | | (4) The heat of the earth; 8 |
---|
32 | 32 | | (5) Small hydro facilities; 9 |
---|
33 | 33 | | (6) Biomass facilities using eligible biomass fuels and maintaining compliance with current 10 |
---|
34 | 34 | | air permits; eligible biomass fuels may be co-fired with fossil fuels, provided that only the 11 |
---|
35 | 35 | | renewable energy fraction of production from multi-fuel facilities shall be considered eligible; 12 |
---|
36 | 36 | | (7) Fuel cells using the renewable resources referenced above in this section; and 13 |
---|
37 | 37 | | (8) Waste-to-energy combustion of any sort or manner, including, without limitation, high-14 |
---|
38 | 38 | | heat medical waste processing facilities, shall in no instance be considered eligible, except for fuels 15 |
---|
39 | 39 | | identified in ยง 39-26-2(6).; and 16 |

45 | 45 | | energy resources are generation units in the NEPOOL control area using renewable energy 1 |
---|
46 | 46 | | resources as defined in this section. 2 |
---|
47 | 47 | | (c) A generation unit located in an adjacent control area outside of the NEPOOL may 3 |
---|
48 | 48 | | qualify as an eligible renewable energy resource, but the associated generation attributes shall be 4 |
---|
49 | 49 | | applied to the renewable energy standard only to the extent that the energy produced by the 5 |
---|
50 | 50 | | generation unit is actually delivered into NEPOOL for consumption by New England customers. 6 |
---|
51 | 51 | | The delivery of the energy from the generation unit into NEPOOL must be generated by: 7 |
---|
52 | 52 | | (1) A unit-specific bilateral contract for the sale and delivery of such energy into NEPOOL; 8 |
---|
53 | 53 | | and 9 |
---|
54 | 54 | | (2) Confirmation from ISO-New England that the renewable energy was actually settled in 10 |
---|
55 | 55 | | the NEPOOL system; and 11 |
---|
56 | 56 | | (3) Confirmation through the North American Reliability Council tagging system that the 12 |
---|
57 | 57 | | import of the energy into NEPOOL actually occurred; or 13 |
---|
58 | 58 | | (4) Any such other requirements as the commission deems appropriate. 14 |
---|
59 | 59 | | (d) NE-GIS certificates associated with energy production from off-grid generation and 15 |
---|
60 | 60 | | customer-sited generation facilities certified by the commission as eligible renewable energy 16 |
---|
61 | 61 | | resources may also be used to demonstrate compliance, provided that the facilities are physically 17 |

62 | 62 | | located in Rhode Island. 18 |
