2323 It is enacted by the General Assembly as follows:
2424 SECTION 1. Section 39-26-5 of the General Laws in Chapter 39-26 entitled "Renewable 1
2525 Energy Standard" is hereby amended to read as follows: 2
2626 39-26-5. Renewable energy resources. 3
2727 (a) Renewable energy resources are: 4
2828 (1) Direct solar radiation; 5
2929 (2) The wind; 6
3030 (3) Movement or the latent heat of the ocean; 7
3131 (4) The heat of the earth; 8
3232 (5) Small hydro facilities; 9
3333 (6) Biomass facilities using eligible biomass fuels and maintaining compliance with current 10
3434 air permits; eligible biomass fuels may be co-fired with fossil fuels, provided that only the 11
3535 renewable energy fraction of production from multi-fuel facilities shall be considered eligible; 12
3636 (7) Fuel cells using the renewable resources referenced above in this section; and 13
3737 (8) Waste-to-energy combustion of any sort or manner, including, without limitation, high-14
3838 heat medical waste processing facilities, shall in no instance be considered eligible, except for fuels 15
3939 identified in ยง 39-26-2(6).; and 16
4040 (9) Nuclear energy sources. 17
4141 (b) For the purposes of the regulations promulgated under this chapter, eligible renewable 18

4545 energy resources are generation units in the NEPOOL control area using renewable energy 1
4646 resources as defined in this section. 2
4747 (c) A generation unit located in an adjacent control area outside of the NEPOOL may 3
4848 qualify as an eligible renewable energy resource, but the associated generation attributes shall be 4
4949 applied to the renewable energy standard only to the extent that the energy produced by the 5
5050 generation unit is actually delivered into NEPOOL for consumption by New England customers. 6
5151 The delivery of the energy from the generation unit into NEPOOL must be generated by: 7
5252 (1) A unit-specific bilateral contract for the sale and delivery of such energy into NEPOOL; 8
5353 and 9
5454 (2) Confirmation from ISO-New England that the renewable energy was actually settled in 10
5555 the NEPOOL system; and 11
5656 (3) Confirmation through the North American Reliability Council tagging system that the 12
5757 import of the energy into NEPOOL actually occurred; or 13
5858 (4) Any such other requirements as the commission deems appropriate. 14
5959 (d) NE-GIS certificates associated with energy production from off-grid generation and 15
6060 customer-sited generation facilities certified by the commission as eligible renewable energy 16
6161 resources may also be used to demonstrate compliance, provided that the facilities are physically 17
6262 located in Rhode Island. 18
6363 SECTION 2. This act shall take effect upon passage. 19
