2121 It is enacted by the General Assembly as follows:
2222 SECTION 1. Section 16-59-9.3 of the General Laws in Chapter 16-59 entitled "Council on 1
2323 Postsecondary Education [See Title 16 Chapter 97 — The Rhode Island Board of Education Act]" 2
2424 is hereby amended to read as follows: 3
2525 16-59-9.3. Student Success Act. 4
2626 Notwithstanding any other provision of the general or public laws: 5
2727 (a)(1) A student, other than a nonimmigrant alien within the meaning of 8 U.S.C. § 6
2828 1101(a)(15), who meets all of the following requirements shall be exempt from paying nonresident 7
2929 tuition at Rhode Island public universities, colleges, or community colleges, if he or she: 8
3030 (i) Attended an approved Rhode Island high school for three (3) or more consecutive years; 9
3131 (ii) Continues to reside in the state of Rhode Island; 10
3232 (iii) Has graduated from an approved Rhode Island high school or received a high school 11
3333 equivalency diploma from the state of Rhode Island; 12
3434 (iv) Has filed, or will file, upon matriculation, with the Rhode Island public university, 13
3535 college, or community college of expected attendance, an affidavit stating that: 14
3636 (A) The student meets the requirements of subsections (1)(i) and (1)(ii) of this section; and 15
3737 (B) If the student is not a United States citizen and does not have a lawful immigration 16
3838 status, that the student has filed an application for lawful immigration status, or will file the 17
3939 application as soon as the student is eligible to do so. The affidavit shall not require students to 18
4040 reveal their immigration or citizenship status. 19

4444 (2) Any nonimmigrant foreign national student, who has resided in Rhode Island for three 1
4545 (3) years and has attended a Rhode Island high school for three (3) years, will be eligible to pay the 2
4646 same in-state tuition as any other Rhode Island student. 3
4747 (3) Identifiable student information obtained pursuant to subsection (1) of this section shall 4
4848 be confidential to the extent provided by state and federal law (including the federal Family 5
4949 Educational Rights and Privacy Act (FERPA)). If information obtained pursuant to this section 6
5050 regarding a student’s immigration status is provided to any agency for purposes other than the 7
5151 implementation of this section, the entity providing the information shall promptly notify the 8
5252 student. 9
5353 (4) The Rhode Island council for postsecondary education shall prescribe rules and 10
5454 regulations as may be necessary for the implementation of this section. 11
5555 (b)(1) A Ukrainian citizen or immediate family member who has been granted temporary 12
5656 parole under the federal Uniting for Ukraine program and who is residing in Rhode Island, shall be 13
5757 eligible for in-state tuition at a Rhode Island public university, college, or community college, 14
5858 provided they meet the following criteria: 15
5959 (i) The individual has been granted parole into the United States as per the federal 16
6060 guidelines. 17
6161 (ii) The individual has resided in Rhode Island for a minimum of one year prior to 18
6262 enrollment at a Rhode Island public university, college, or community college; 19
6363 (iii) The individual is enrolled or intends to enroll as a full-time student at a public 20
6464 university, college, or community college in Rhode Island. 21
6565 (2) Applicants for in-state tuition under this subsection shall: 22
6666 (i) Provide proof of parole status, as granted by the U.S. Department of Homeland Security 23
6767 under the Uniting for Ukraine program; 24
6868 (ii) Submit evidence of continuous residence in Rhode Island for at least one year prior to 25
6969 enrollment; 26
7070 (iii) Provide any required documentation, including Form I-94, Arrival/Departure Record, 27
7171 or any official documentation from the U.S. Citizenship and Immigration Services (USCIS) 28
7272 confirming their parole status; and 29
7373 (iv) Complete and submit an application for in-state tuition to a Rhode Island public 30
7474 university, college, or community college. 31
7575 SECTION 2. This act shall take effect upon passage. 32
