2222 It is enacted by the General Assembly as follows:
2323 SECTION 1. Section 5-10-23 of the General Laws in Chapter 5-10 entitled "Barbers, 1
2424 Hairdressers, Cosmeticians, Manicurists and Estheticians" is hereby amended to read as follows: 2
2525 5-10-23. Fixed place of business. 3
2626 (a) Except as provided in this section, manicuring, esthetics, barbering and/or hairdressing 4
2727 and cosmetic therapy, as defined in this chapter, shall be practiced only in a shop licensed under § 5
2828 5-10-15. Nothing contained in this chapter shall be construed to prohibit the practice of barbering, 6
2929 manicuring, and hairdressing and cosmetic therapy and esthetics in the same shop or place of 7
3030 business. 8
3131 (b) Nothing in this section shall restrict a hairdresser licensed pursuant to this chapter, 9
3232 operating in a licensed nursing service agency, from providing services to an individual who is 10
3333 homebound at their home. For purposes of this section, “homebound” is defined as any person who 11
3434 is considered housebound for purpose of federal Medicare eligibility. 12
3535 (c) Nothing in this section shall restrict any person licensed pursuant to this chapter from 13
3636 providing services to an individual who is homebound, has special needs or sensory-related 14
3737 disorders or differences, using a mobile salon or unit at their home as verified by a licensed 15
3838 healthcare professional. The use of chemical treatments shall not be permitted in a mobile salon or 16
3939 unit. 17
4040 (d) Nothing in this section shall restrict or prohibit any person licensed pursuant to this 18

4444 chapter from providing services to an individual residing in any Department of Housing and Urban 1
4545 Development (H.U.D.) recognized housing for the elderly in the H.U.D. recognized housing in 2
4646 which the individual resides. Those services shall be provided in a separate room inspected by the 3
4747 department of health. Students enrolled in programs of hairdressing, barbering and/or cosmetology 4
4848 are prohibited in H.U.D. recognized housing. 5
4949 (e) Nothing in this section shall restrict or prohibit any person licensed pursuant to this 6
5050 chapter from providing services to an individual outside a licensed shop as part of a special occasion 7
5151 event, such as a wedding or prom, so long as those services are limited to hair styling and makeup, 8
5252 and the health and sanitation standards expected of licensees in licensed shops are followed. 9
5353 SECTION 2. This act shall take effect upon passage. 10
