1616 An Act to authorize the Department of Corrections to construct a prison facility for 1
1717 offenders committed to the Department of Corrections in Lincoln County, to 2
1818 make an appropriation therefor, to transfer moneys to the incarceration 3
1919 construction fund, and to declare an emergency. 4
2020 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA: 5
2121 Section 1. The Department of Corrections may contract for the construction of a prison facility 6
2222 for offenders committed to the Department of Corrections, in Lincoln County, together with 7
2323 furnishings and equipment, including heating, air conditioning, plumbing, water, sewer, 8
2424 electric facilities, architectural and engineering services, and other services and 9
2525 improvements, as may be required to complete the project. 10
2626 Section 2. A municipality in Lincoln County may treat sewage from the prison facility 11
2727 described in section 1 of this Act. 12
2828 Section 3. The state treasurer shall transfer $148,109,837 from the general fund and 13
2929 $33,926,134 from the budget reserve fund to the incarceration construction fund, for the 14
3030 construction of the prison facility described in section 1 of this Act. 15
3131 Section 4. There is appropriated $763,000,000 from the incarceration construction fund, to 16
3232 the Department of Corrections, for the construction of the prison facility described in section 17
3333 1 of this Act. 18
3434 Section 5. The administration of the design and construction of the project authorized in this 19
3535 Act shall be under the general charge and supervision of the Bureau of Human Resources and 20
3636 Administration, as provided in chapter 5-14. 21
3737 Section 6. The secretary of the Department of Corrections shall approve vouchers and the 22
3838 state auditor shall draw warrants to pay expenditures authorized in this Act. 23 25.462.11 2 1025

4141 Section 7. Any amounts appropriated in this Act not lawfully expended or obligated by June 1
4242 30, 2030, shall revert in accordance with the procedures prescribed in chapter 4-8. 2
4343 Section 8. Whereas, this Act is necessary for the support of the state government and its 3
4444 existing public institutions, an emergency is hereby declared to exist, and this Act shall be in 4
4545 full force and effect from and after its passage and approval. 5
