| 17 | 17 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA: 2 |

| 18 | 18 | | Section 1. That a NEW SECTION be added to chapter 37-24: 3 |

| 19 | 19 | | Except as provided in section 2 of this Act, a person must accept cash as a form of 4 |
|---|
| 20 | 20 | | payment for any goods or services sold to a consumer if: 5 |
|---|
| 21 | 21 | | (1) The sale and payment for the goods or services occurs in person; 6 |
|---|
| 22 | 22 | | (2) The person selling the goods or services, or an individual employed by the person 7 |
|---|
| 23 | 23 | | selling the goods or services, is physically present at the time of the sale to accept 8 |
|---|
| 24 | 24 | | a cash payment; and 9 |
|---|
| 25 | 25 | | (3) The purchaser of the goods or services chooses to pay the purchase price using 10 |
|---|
| 26 | 26 | | cash. 11 |

| 27 | 27 | | For purposes of this section, "cash" means physical coin, currency, or note that is 12 |
|---|
| 28 | 28 | | designed as legal tender by federal law. 13 |

| 29 | 29 | | Section 2. That a NEW SECTION be added to chapter 37-24: 14 |

| 30 | 30 | | The provisions of section 1 of this Act do not apply to: 15 |
|---|
| 31 | 31 | | (1) Financial institutions, as defined in ยง 10-43-1; 16 |
|---|
| 32 | 32 | | (2) The sale of goods or services that require a credit card for purposes of placing a 17 |
|---|
| 33 | 33 | | security deposit or covering unforeseen damages or expenses; or 18 |
|---|
| 34 | 34 | | (3) The sale of, or payment for, goods or services occurring on an airplane. 19 |

| 35 | 35 | | Section 3. That a NEW SECTION be added to chapter 37-24: 20 |

| 36 | 36 | | The state and its political subdivisions must accept cash as a form of payment for 21 |
|---|
| 37 | 37 | | any fee or charge imposed on any member of the public if; 22 |
