11-ENTITLED An Act to modify the persons eligible to sign an affidavit for proof of
12-homelessness for purposes of waiving the fee for a nondriver identification
13-card.
14-BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
15-Section 1. That § 32-12-17.16 be AMENDED:
16-32-12-17.16. The Department of Public Safety shall waive the fee one time for an
17-original nondriver identification card or a duplicate nondriver identification card if the
18-applicant is homeless.
19-In order for the fee to be waived, the applicant must submit, with the application,
20-an affidavit signed by a homeless services provider attesting that the applicant is
21-homeless.
22-For the purposes of this section, the term "homeless" means an individual who:
23-(1) Lacks a fixed, regular, and adequate nighttime residence;
24-(2) Has a primary nighttime residence that is a place not ordinarily used as a regular
25-sleeping accommodation for human beings; or
26-(3) Is living in a homeless shelter.
27-For purposes of this section, "homeless services provider" means an official or
28-employee of any government or nonprofit agency that provides a food bank, homeless
29-shelter, housing assistance program, homeless outreach or advocacy program, or any
30-similar program; a homeless liaison designated by a school district, as described by 42
31-U.S.C. § 11432 (January 1, 2025); a school counselor, certified by the Department of
32-Education; a school nurse, licensed in accordance with chapter 36-9; or a social worker,
33-licensed in accordance with chapter 36-26. 25.567.13 2 1075
