1616 An Act to establish the crime of hazing and to provide a penalty therefor. 1
1717 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA: 2
1818 Section 1. That a NEW SECTION be added to chapter 22-18: 3
1919 A person who commits an act of hazing is guilty of a Class 1 misdemeanor. A person 4
2020 who commits an act of hazing that causes serious bodily injury to another is guilty of a 5
2121 Class 6 felony. 6
2222 It is not a defense to prosecution under this section that the victim consented to 7
2323 the act of hazing. 8
2424 For the purposes of this section, "hazing" means any activity by which a person 9
2525 recklessly endangers the health or safety of, or causes a risk of extreme psychological 10
2626 distress or bodily injury to, another person for purposes of initiation or admission into, or 11
2727 affiliation with, any organization operating in connection with a school, college, or 12
2828 university. The term "hazing" does not include reasonable and customary interscholastic 13
2929 or intercollegiate athletic practices, competitions, or events, or any authorized law 14
3030 enforcement or military training. 15
