An Act to modify provisions pertaining to the compensation of a recount board. 1
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA: 2
Section 1. That § 12-21-4 be AMENDED: 3
12-21-4. The recount referee shall receive compensation in the same amount as 4
court appointed court-appointed counsel, and the other two members so appointed to the 5
recount board shall each receive compensation in the amount of twenty-five dollars per 6
day or in an amount equal to the state minimum hourly wage, whichever is the greatest 7
an amount determined by the governing body of the jurisdiction in which the election is 8
held. 9
Section 2. That § 12-21-4.1 be AMENDED: 10
12-21-4.1. The members of the Each member of a recount board shall receive 11
mileage for the miles traveled each day of the recount from their the member's points of 12
residence at the rate set pursuant to § 3-9-1; however, this provision shall not apply to 13
the first ten miles traveled each day. 14
