An Act to amend provisions pertaining to the maintenance and publication of the 1 
statewide voter registration file. 2 
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA: 3 
Section 1. That § 12-4-37 be AMENDED: 4 
12-4-37. The secretary of state shall establish and maintain a computerized 5 
system for maintaining and utilizing the voter registration file and transmitting voter 6 
registration information from each county auditor to the Office of the Secretary of 7 
State.The State Board of Elections shall promulgate rules, pursuant to chapter 1-26, The 8 
computer system must be hosted by the state and may not use any outside contractor, 9 
host system, vendor, or site. All voter registration data must be maintained by state 10 
employees, using an in-house server, and may not be shared with any outside contractor 11 
or vendor, except as provided in § 12-4-40.1. The State Board of Elections shall consult 12 
with the Bureau of Information and Telecommunications to develop and implement 13 
procedures to secure the computerized system used for the voter registration file from 14 
external threats that could damage the integrity of the voter registration system. 15 
Each county auditor shall transmit any changes to the master registration file or 16 
the absentee voter log to the secretary of state on a daily basis. The county auditor shall 17 
transmit updated information contained in the county voter registration system, including 18 
voter registration information and voter election history information, to the Office of the 19 
Secretary of State secretary of state not later than July fifteenth seven days after each 20 
primary election and December fifteenth after each general election. 21
