An Act to provide immunity for off -duty law enforcement officers who perform a 1
citizen's arrest or assist with a lawful arrest. 2
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA: 3
Section 1. That a NEW SECTION be added to chapter 23A-3: 4
Any law enforcement officer, as defined in § 23-3-27, who performs a citizen's 5
arrest, pursuant to § 23A-3-3, or otherwise assists in a lawful arrest under chapter 23A-6
3, while the officer is off duty, is immune from criminal prosecution and from civil liability 7
for the arrest. 8
