11-ENTITLED An Act to waive the driver license renewal period for members of the
12-military and their families, and employees of the state department.
13-BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
14-Section 1. That § 32-12-42 be AMENDED:
15-32-12-42. An operator's license, motorcycle operator's license, restricted minor's
16-permit, or motorcycle restricted minor's permit expires on the licensee's birthday in the
17-fifth year following the issuance of the license, or on the date of expiration of the
18-applicant's authorized stay in the United States, as determined by the systematic alien
19-verification for entitlements system or an alternate method approved by the United States
20-Department of Homeland Security or, if there is no expiration date, for a period no longer
21-than one year from the date of issuance, whichever occurs first.
22-Except as provided in section 2 of this Act, an operator's license, motorcycle
23-operator's license, restricted minor's permit, or motorcycle restricted minor's permit is
24-renewable one hundred eighty days before its expiration, upon application and payment
25-of the required fee.
26-A license renewed before its expiration expires five years after the licensee's
27-ensuing birthday, or on the date of expiration of the applicant's authorized stay in the
28-United States, as determined by the systematic alien verification for entitlements system
29-or an alternate method approved by the United States Department of Homeland Security
30-or, if there is no expiration date, for a period no longer than one year from date of
31-issuance, whichever occurs first.
32-The department must waive the knowledge and driving tests for renewal, if the
33-licensee applies and makes payment of the required fee within thirty days following the
34-expiration date. If the licensee applies and makes payment of the required fee thirty-one
35-or more days after the expiration date of the license, the licensee must take the knowledge
36-test as required by § 32-12-4. 25.243.12 2 1160

39-expires five years from the licensee's previous birthday, or on the date of expiration of
40-the applicant's authorized stay in the United States, as determined by the systematic alien
41-verification for entitlements system or an alternate method approved by the United States
42-Department of Homeland Security or, if there is no expiration date, for a period no longer
43-than one year from date of issuance, whichever occurs first.
44-Section 2. That a NEW SECTION be added to chapter 32-12:
45-A valid operator's license, motorcycle operator's license, restricted minor's permit,
46-motorcycle restricted minor's permit, instruction permit, or motorcycle instruction permit
47-is not subject to the one hundred eighty-day renewable period in § 32-12-42 and may be
48-renewed at any time regardless of the expiration date, if held by:
49-(1) An active-duty member of the armed forces of the United States, as defined in
50-§ 33-1-1;
51-(2) An employee of the United States Department of State serving outside of the
52-United States; or
53-(3) A spouse or a dependent of an active-duty member of the armed forces of the
