An Act to provide that equine dental maintenance not constitute the practice of 1 veterinary medicine. 2 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA: 3 Section 1. That ยง 36-12-2 be AMENDED: 4 36-12-2. The following persons shall may not be considered to be engaging in the 5 practice of veterinary medicine in this state: 6 (1) Those who administer to livestock, title of which rests in himself, or in his regular 7 employer, or free service in any case; 8 (2) Those who conduct experimentation in scientific research in the development of 9 methods, technics, or treatment, directly or indirectly applicable to the problems 10 of medicine and who in connection therewith uses animals; 11 (3) Services to poultry in its entirety; 12 (4) Regular students in a legally chartered and recognized college of veterinary 13 medicine, while in the performance of studies and acts assigned by their 14 instructors; 15 (5) Those who are licensed in another state of the United States when engaged in this 16 state in consultation with veterinarians legally practicing herein, providing such 17 consultation does not exceed thirty days in any one year; 18 (6) Those who are senior students in an approved school of veterinary medicine and 19 who shall obtain from the Board of Veterinary Medical Examiners an undergraduate 20 permit to practice in the office and under the direct supervision of any veterinarian 21 practicing within this state; 22 (7) Those who are employees of the State of South Dakota or the United States of 23 America while in the performance of their duties as such employee; 24 25.770.15 2 1176 Underscores indicate new language. (8) Those selling drugs, medicines, household remedies, or appliances at wholesale or 1 retail and advising as to the use and purpose of such drugs, medicines, household 2 remedies, or appliances; 3 (9) Veterinary livestock assistants registered by the State Board of Veterinary Medical 4 Examiners who work under the supervision of a veterinarian licensed in the State 5 of South Dakota to perform spaying of cattle and administration of biologics and 6 pharmaceuticals under the order of their supervising veterinarians. The State 7 Board of Veterinary Medical Examiners shall promulgate rules pursuant to chapter 8 1-26 for the registration of veterinary livestock assistants; and 9 (10) Those who engage in the removal of equine enamel points, smoothing, contouring, 10 and leveling of equine dental arcades and incisors, and the removal of equine 11 deciduous and mobile teeth, with handheld or motorized equipment . 12
