18 | 18 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA: 3 |

19 | 19 | | Section 1. That a NEW SECTION be added to chapter 13-55: 4 |
---|
20 | 20 | | An individual who has been a resident of this state for at least five years, and is 5 |
---|
21 | 21 | | over the age of fifteen and under the age of twenty-five, is entitled to tuition without cost 6 |
---|
22 | 22 | | at any institution under the control of the Board of Regents or the South Dakota Board of 7 |
---|
23 | 23 | | Technical Education, if: 8 |
---|
24 | 24 | | (1) The individual's parent died or sustained a total disability, permanent in nature, 9 |
---|
25 | 25 | | while in the service of the South Dakota National Guard or the armed forces of the 10 |
---|
26 | 26 | | United States, as defined in § 13-55-7; 11 |
---|
27 | 27 | | (2) The individual's parent served in the South Dakota National Guard or the armed 12 |
---|
28 | 28 | | forces of the United States for at least one year; and 13 |
---|
29 | 29 | | (3) The individual's parent was a bona fide resident of this state for the five-year period 14 |
---|
30 | 30 | | immediately preceding service in the South Dakota National Guard or the armed 15 |
---|
31 | 31 | | forces of the United States. 16 |
---|
32 | 32 | | An individual is eligible to receive the benefit provided by this section for four 17 |
---|
33 | 33 | | consecutive academic years. 18 |
---|
34 | 34 | | For the purposes of this section, "parent" means a natural parent, adoptive parent, 19 |
---|
35 | 35 | | or stepparent. 20 |
---|

54 | 54 | | Act, means all components of the Army, Navy, Marine Corps, Air Force, Space Force, and 13 |

58 | 58 | | Board of Regents. The Board of Regents shall determine whether the applicant is entitled 17 |

59 | 59 | | to the benefitsIn order to receive the benefit established in section 1 or 2 of this Act, an 18 |
---|
60 | 60 | | individual intending to apply to an institution under the control of the Board of Regents 19 |
---|
61 | 61 | | must submit an application to the Board of Regents. 20 |

62 | 62 | | In order to receive the benefit established in section 1 or 2 of this Act, an individual 21 |
---|
63 | 63 | | intending to apply to an institution under the control of the South Dakota Board of 22 |
---|
64 | 64 | | Technical Education must submit an application to the South Dakota Board of Technical 23 |
---|
65 | 65 | | Education. 24 |
---|
66 | 66 | | The Board of Regents may promulgate rules pursuant to chapter 1-26 to 25 |
---|
67 | 67 | | accomplish the purposes of §§ 13-55-6 to 13-55-9, inclusive § 13-55-9 and sections 1 26 |

68 | 68 | | and 2 of this Act. 27 |

95 | 95 | | the benefits established in section1 or 2 of this Act, until the individual has completed four 22 |
---|
96 | 96 | | academic years at an eligible institution. 23 |

97 | 97 | | Section 7. That § 13-55-6 be REPEALED. 24 |
---|
98 | 98 | | Any person under the age of twenty-five years, a resident of this state, who is a 25 |
---|
99 | 99 | | child of a deceased parent, mother or father, who was a veteran as defined in § 33A-2-1, 26 |
---|
100 | 100 | | who was for at least six months immediately prior to entry into active service a bona fide 27 |
---|
101 | 101 | | resident of this state, and who suffered death from any cause while in the service of the 28 |
---|
102 | 102 | | armed forces of the United States, is entitled to free tuition and entitled to attend and 29 |

103 | 103 | | pursue any course or courses of study in any state educational institution under the control 30 |

104 | 104 | | and management of the Board of Regents or any technical college as defined in § 13-39A-31 |
