16	16		An Act to increase the maximum amount allowable for the livestock ownership 1
17	17		inspection fee and to declare an emergency. 2
18	18		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA: 3
19	19		Section 1. That § 40-18-16 be AMENDED: 4
20	20		40-18-16. The board may promulgate rules, pursuant to chapter 1-26, to: 5
21	21		(1) Describe prohibited brand symbols for various types of livestock and identify 6
22	22		locations on animals where a brand is permitted; 7
23	23		(2) Provide for the registration, transfer, and renewal of livestock brands; 8
24	24		(3) Establish a brand registration fee not to exceed fifty dollars; 9
25	25		(4) Establish a brand renewal fee not to exceed eighteen dollars per year or a brand 10
26	26		renewal fee not to exceed ninety dollars for each five-year ownership period and a 11
27	27		brand transfer fee not to exceed fifty dollars; 12
28		-	(5) Establish an ownership inspection fee not to exceed one dollar and ~~thirty-five~~ cents 13

29	29		for each head of livestock; 14
30	30		(6) Establish recordable livestock brands; 15
31	31		(7) Establish law enforcement, ownership inspection, and transportation requirements 16

33	33		(8) Establish a duplicate certificate fee not to exceed twenty dollars; 18
34	34		(9) Establish a mileage fee for inspectors not to exceed the rate set pursuant to § 3-19
35	35		9-1; 20
36	36		(10) Establish an inspection fee for livestock located outside the ownership inspection 21
37		-	area not to exceed one dollar and ~~thirty-five~~ cents for each head of livestock; and 22
	37	+	area not to exceed one dollar and seventy cents for each head of livestock; and 22
38	38		(11) Establish a brand registration application fee not to exceed fifty dollars. 23
39	39		Section 2. Whereas, this Act is necessary for the support of the state government and its 24
40	40		existing public institutions, an emergency is hereby declared to exist, and this Act shall be in 25
41	41		full force and effect from and after its passage and approval. 26
