1818 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA: 3
1919 Section 1. That § 40-18-16 be AMENDED: 4
2020 40-18-16. The board may promulgate rules, pursuant to chapter 1-26, to: 5
2121 (1) Describe prohibited brand symbols for various types of livestock and identify 6
2222 locations on animals where a brand is permitted; 7
2323 (2) Provide for the registration, transfer, and renewal of livestock brands; 8
2424 (3) Establish a brand registration fee not to exceed fifty dollars; 9
2525 (4) Establish a brand renewal fee not to exceed eighteen dollars per year or a brand 10
2626 renewal fee not to exceed ninety dollars for each five-year ownership period and a 11
2727 brand transfer fee not to exceed fifty dollars; 12
28-(5) Establish an ownership inspection fee not to exceed one dollar and thirty-five cents 13
28+(5) Establish an ownership inspection fee not to exceed one dollar and seventy cents 13
2929 for each head of livestock; 14
3030 (6) Establish recordable livestock brands; 15
3131 (7) Establish law enforcement, ownership inspection, and transportation requirements 16
3232 within or without the ownership inspection area; 17
3333 (8) Establish a duplicate certificate fee not to exceed twenty dollars; 18

3939 Section 2. Whereas, this Act is necessary for the support of the state government and its 24
4040 existing public institutions, an emergency is hereby declared to exist, and this Act shall be in 25
4141 full force and effect from and after its passage and approval. 26
