11-ENTITLED An Act to make an appropriation for victim services provided by nonprofit
12-organizations.
13-BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
14-Section 1. There is appropriated $5,000,000 from the general fund, to the Department of
15-Public Safety, for the purpose of providing grants to nonprofit organizations that assist:
16-(1) Children who have been abused or neglected;
17-(2) Victims of domestic violence;
18-(3) Victims of sexual assault;
19-(4) Victims of commercial sexual exploitation; or
20-(5) Victims of human trafficking.
21-Section 2. The Department of Public Safety shall annually provide grants in accordance with
22-section 1 of this Act on the basis of applications received during the period beginning July first
23-and ending August thirty-first, of each year.
24-Recipients may use the grants for:
25-(1) The provision of emergency and transitional services, including food, lodging, and
26-transportation;
27-(2) The provision of counseling services;
28-(3) The support of a crisis line;
29-(4) Case management and facility staffing needs;
30-(5) Training, certification, or employment of a sexual assault nurse examiner; and
31-(6) Services provided through a child advocacy center.
32-The department may award grants for any request not receiving full funding from
33-any other agency of this state. The department shall consider the financial situation of the
34-applicant and prioritize awarding grants to an applicant who demonstrates a financial need 25.857.14 2 1221

36-or inability to raise sufficient moneys for the services or uses in subdivisions (1) to (6),
37-inclusive, of this section.
38-Grants may not be used to establish a new program or organization, or for the
39-provision of legal services.
40-The Department of Public Safety may expend moneys from the appropriation
41-provided in section 1 of this Act for the administrative costs necessary to provide the
42-grants.
43-Section 3. The secretary of the Department of Public Safety shall approve vouchers and the
44-state auditor shall draw warrants to pay expenditures authorized by this Act.
45-Section 4. Any amounts appropriated in this Act not lawfully expended or obligated shall
46-revert in accordance with the procedures prescribed in chapter 4-8.
