An Act to require an ownership disclosure for any non -individual entity that 1
exercises eminent domain. 2
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA: 3
Section 1. That a NEW SECTION be added to chapter 21-35: 4
If an entity, including a corporation, group, or any person other than an individual, 5
files a petition pursuant to this chapter, the entity must attach a verified ownership 6
disclosure containing: 7
(1) The legal name of the entity; 8
(2) The primary address of the entity; 9
(3) Any registered agent contact information; 10
(4) Documentation of the entity’s legal status, including evidence of incorporation, 11
organization, or registration under the laws of this state; and 12
(5) The name, address, and legal status of any member, owner, partner, shareholder, 13
or other person with an ownership interest in the entity. 14
