12-A CONCURRENT RESOLUTION, Supporting the Electoral College, denouncing the
13-National Popular Vote Interstate Compact, and inviting interested states to
14-form the Electoral College Interstate Compact.
15- WHEREAS, the current electoral college system respects states as the essential units in
16-our compound republic, protecting their power and voice in presidential elections; and
17- WHEREAS, the current electoral college system respects the separation and balance of
18-power and authority between the states and the federal government; and
19- WHEREAS, the current electoral college system creates a needed balance between rural
20-and urban interests and ensures that the winning candidate has support from multiple regions
21-of the country; and
22- WHEREAS, the current electoral college system ensures that each state's electoral votes
23-are awarded based on how the state's citizens vote; and
24- WHEREAS, the current electoral college system best preserves our constitutional
25-separation of powers and prevents the fracture of America's political structure; and
26- WHEREAS, the founding fathers rejected a national popular vote for president and instead
27-created the Electoral College; and
28- WHEREAS, the National Popular Vote Interstate Compact diminishes the importance of
29-individual states in presidential elections, creates the potential for nationwide recounts, and
30-opens the door to greater federal control; and
31- WHEREAS, under the National Popular Vote Interstate Compact, a state's electoral vote
32-could be awarded to a candidate opposed by the majority of the state's citizens; and 25.862.12 2 HCR6013

34- WHEREAS, the constitutionality of the National Popular Vote Interstate Compact is
35-doubtful because it appears to violate the text of the Compact Clause of the United States
36-Constitution and the intent of the electoral college clauses;
37- NOW, THEREFORE, BE IT RESOLVED, by the House of Representatives of the One
38-Hundredth Legislature of the State of South Dakota, the Senate concurring therein, that the
39-Legislature supports the Electoral College and believes the National Popular Vote Interstate
40-Compact may be unconstitutional; and
41- BE IT FURTHER RESOLVED, that this Legislature invites all other interested states to form
42-an Electoral College Interstate Compact to prohibit electors from participating states from
43-casting the elector's vote in accordance with the national popular vote count and require the
44-participating states to legally challenge the constitutionality of the National Popular Vote
45-Interstate Compact; and
46- BE IT FURTHER RESOLVED, that this Legislature proposes forming the Electoral College
47-Interstate Compact when four other states declare their intent to form the Electoral College
48-Interstate Compact, at which time the interested states shall take appropriat e steps to
49-organize and form the compact; and
50- BE IT FURTHER RESOLVED, that the secretary of state forward copies of this resolution to
51-the secretaries of state and majority and minority leaders in each legislative chamber in the
52-states of Alabama, Alaska, Arkansas, Arizona, Florida, Georgia, Iowa, Idaho, Indiana, Kansas,
53-Kentucky, Louisiana, Michigan, Mississippi, Missouri, Montana, Nebraska, Nevada, New
54-Hampshire, North Carolina, Ohio, Oklahoma, Pennsylvania, South Carolina, Tennessee,
