11-ENTITLED An Act to update the membership of the Animal Industry Board to include
12-a poultry producer.
13-BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
14-Section 1. That § 40-3-2 be AMENDED:
15-40-3-2. The Animal Industry Board shall consist of eight members appointed by
16-the Governor. Any interested farm, commodity, livestock auction or livestock commission,
17-or veterinary organization may submit nominations to the Governor from which
18-appointments may be made. Each term is for a period of three years and until the
19-successor is appointed and qualified. Any vacancy may be filled by appointment of the
20-Governor for the balance of the unexpired term.
21-The terms of members begin on October thirty-first of the calendar year in which
22-the Governor appoints the member, unless otherwise designated by the Governor. The
23-appointee's term expires on October thirtieth in the third year of appointment.
24-Any member's term ending June 30, 2013, or thereafter is extended to October
25-thirtieth in the year the term is to expire.
26-Section 2. That § 40-3-3 be AMENDED:
27-40-3-3. All members of the Animal Industry Board must be residents and electors
28-of the state. One member must be a cattleman, one member must be a sheepman, one
29-member must be a livestock feeder, one member must be a hog producer, one member
30-must be an owner-operator of a livestock auction or commission company, one member
31-must be a dairy producer, one member must be a poultry producer, and one member
32-must be a veterinarian who is actively engaged in practice in the state. All members, other
33-than the veterinarian, must be persons actively and actually raising or marketing livestock
34-or poultry within the state. The members must qualify by taking and subscribing the oath
35-of office required of other civil officers of the state. 25.700.11 2 120

37-Section 3. That § 40-3-10 be AMENDED:
38-40-3-10. In Title 40, the terms "livestock," "domestic animals," and "nondomestic
39-animal" include poultry, unless a different intention is clearly implied. The term "poultry"
40-includes chickens, turkeys, ducks, geese, and any other game bird raised in captivity,
