1616 An Act to establish informational and membership requirements for a labor union, 1
1717 organization, or association and provide a penalty therefor. 2
1818 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA: 3
1919 Section 1. That a NEW SECTION be added to chapter 60-9: 4
2020 Upon enrollment of a member, a labor union, organization, or association must 5
2121 provide a document stating the services that the labor union, organization, or association 6
2222 provides as a benefit of membership and the obligations of the labor union, organization, 7
2323 or association to the member. 8
2424 A violation of this section is a Class 2 misdemeanor. 9
2525 Section 2. That a NEW SECTION be added to chapter 60-9: 10
2626 A labor union, organization, or association must prepare and update, as necessary, 11
2727 a document stating: 12
2828 (1) How membership fees collected by the labor union, organization, or association are 13
2929 spent; and 14
3030 (2) The amount of membership fees that are forwarded to other labor unions, 15
3131 organizations, or associations, by name. 16
3232 The document must be provided to a prospective member prior to enrollment, to 17
3333 a member prior to reenrollment, and upon the request by a member. 18
3434 A violation of this section is a Class 2 misdemeanor. 19
3535 Section 3. That a NEW SECTION be added to chapter 60-9: 20
3636 A labor union, organization, or association shall permit a member to withdraw from 21
3737 membership at any time. The labor union, organization, or association shall prorate any 22
3838 dues paid by the member and refund the dues, within thirty days of the withdrawal. 23
3939 A violation of this section is a Class 2 misdemeanor. 24
