1818 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA: 3
1919 Section 1. The Department of Public Safety shall establish a biomonitoring pilot program to 4
2020 test firefighters in this state for perfluoroalkyl and polyfluoroalkyl substances. The department 5
2121 shall: 6
2222 (1) Provide for the collection and testing of blood samples, from individuals approved 7
2323 under section 2 of this Act, for measuring perfluoroalkyl and polyfluoroalkyl 8
2424 substances; 9
2525 (2) Disclose the results of the blood sample to the individual who was tested; 10
2626 (3) Assess health implications that may be attributed to elevated levels of 11
2727 perfluoroalkyl and polyfluoroalkyl substances in the tested individuals; and 12
2828 (4) Identify regions of the state, if any, where tested individuals experience elevated 13
2929 levels of perfluoroalkyl and polyfluoroalkyl substances. 14
3030 Section 2. The Department of Public Safety may approve an individual for participation in 15
3131 the biomonitoring pilot program if: 16
3232 (1) The individual: 17
3333 (a) Served as a firefighter in this state for at least one year; or 18
3434 (b) Is currently serving as a firefighter in this state and has served for at least 19
3535 one year; and 20
3636 (2) The individual applies to participate in the program. 21
3737 The department shall establish the time and manner in which an individual may 22
3838 apply to participate and shall make any required forms available on its website. 23 25.129.11 2 162

4141 Section 3. The Department of Public Safety may contract with a third party for any of the 1
4242 following: 2
4343 (1) Administration of the biomonitoring pilot program; and 3
4444 (2) Storage of data collected under the program. 4
4545 Section 4. The Department of Public Safety, or any third party that the department contracts 5
4646 with as provided in section 3 of this Act, may not disclose the name, address, telephone 6
4747 number, or other identifying information of an individual who participates in the biomonitoring 7
4848 pilot program. 8
4949 Section 5. On or before July 1, 2028, the Department of Public Safety shall submit a report 9
5050 to the Legislature that includes: 10
5151 (1) A summary of the results and conclusions from the biomonitoring pilot program; 11
5252 and 12
5353 (2) Recommendations for reducing the levels of perfluoroalkyl and polyfluoroalkyl 13
5454 substances in firefighters in this state. 14
5555 Section 6. There is appropriated $200,000 from the general fund, to the Department of Public 15
5656 Safety, to establish and operate the biomonitoring pilot program, as provided for in sections 16
5757 1 to 5, inclusive, of this Act. 17
5858 Section 7. The secretary of the Department of Public Safety shall approve vouchers and the 18
5959 state auditor shall draw warrants to pay expenditures authorized in this Act. 19
6060 Section 8. Any amounts appropriated in this Act not lawfully expended or obligated shall 20
6161 revert in accordance with the procedures prescribed in chapter 4-8. 21
6262 Section 9. This Act is effective beginning June 30, 2025. 22
6363 Section 10. Sections 1 to 3 of this Act, inclusive, expire on July 1, 2028. 23
