18 | 18 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA: 3 |

19 | 19 | | Section 1. The Department of Public Safety shall establish a biomonitoring pilot program to 4 |
---|
20 | 20 | | test firefighters in this state for perfluoroalkyl and polyfluoroalkyl substances. The department 5 |
---|
21 | 21 | | shall: 6 |
---|
22 | 22 | | (1) Provide for the collection and testing of blood samples, from individuals approved 7 |
---|
23 | 23 | | under section 2 of this Act, for measuring perfluoroalkyl and polyfluoroalkyl 8 |
---|
24 | 24 | | substances; 9 |
---|
25 | 25 | | (2) Disclose the results of the blood sample to the individual who was tested; 10 |
---|
26 | 26 | | (3) Assess health implications that may be attributed to elevated levels of 11 |
---|
27 | 27 | | perfluoroalkyl and polyfluoroalkyl substances in the tested individuals; and 12 |
---|
28 | 28 | | (4) Identify regions of the state, if any, where tested individuals experience elevated 13 |
---|
29 | 29 | | levels of perfluoroalkyl and polyfluoroalkyl substances. 14 |
---|
30 | 30 | | Section 2. The Department of Public Safety may approve an individual for participation in 15 |
---|
31 | 31 | | the biomonitoring pilot program if: 16 |
---|
32 | 32 | | (1) The individual: 17 |
---|
33 | 33 | | (a) Served as a firefighter in this state for at least one year; or 18 |
---|
34 | 34 | | (b) Is currently serving as a firefighter in this state and has served for at least 19 |
---|
35 | 35 | | one year; and 20 |
---|
36 | 36 | | (2) The individual applies to participate in the program. 21 |
---|
37 | 37 | | The department shall establish the time and manner in which an individual may 22 |
---|

41 | 41 | | Section 3. The Department of Public Safety may contract with a third party for any of the 1 |

43 | 43 | | (1) Administration of the biomonitoring pilot program; and 3 |
---|
44 | 44 | | (2) Storage of data collected under the program. 4 |
---|
45 | 45 | | Section 4. The Department of Public Safety, or any third party that the department contracts 5 |
---|
46 | 46 | | with as provided in section 3 of this Act, may not disclose the name, address, telephone 6 |
---|
47 | 47 | | number, or other identifying information of an individual who participates in the biomonitoring 7 |
---|
48 | 48 | | pilot program. 8 |
---|
49 | 49 | | Section 5. On or before July 1, 2028, the Department of Public Safety shall submit a report 9 |
---|
50 | 50 | | to the Legislature that includes: 10 |
---|
51 | 51 | | (1) A summary of the results and conclusions from the biomonitoring pilot program; 11 |
---|
52 | 52 | | and 12 |
---|
53 | 53 | | (2) Recommendations for reducing the levels of perfluoroalkyl and polyfluoroalkyl 13 |
---|
54 | 54 | | substances in firefighters in this state. 14 |
---|
55 | 55 | | Section 6. There is appropriated $200,000 from the general fund, to the Department of Public 15 |
---|
56 | 56 | | Safety, to establish and operate the biomonitoring pilot program, as provided for in sections 16 |
---|
57 | 57 | | 1 to 5, inclusive, of this Act. 17 |
---|
58 | 58 | | Section 7. The secretary of the Department of Public Safety shall approve vouchers and the 18 |
---|
59 | 59 | | state auditor shall draw warrants to pay expenditures authorized in this Act. 19 |
---|
60 | 60 | | Section 8. Any amounts appropriated in this Act not lawfully expended or obligated shall 20 |
---|
61 | 61 | | revert in accordance with the procedures prescribed in chapter 4-8. 21 |
---|
62 | 62 | | Section 9. This Act is effective beginning June 30, 2025. 22 |
---|
63 | 63 | | Section 10. Sections 1 to 3 of this Act, inclusive, expire on July 1, 2028. 23 |
