11-ENTITLED An Act to clarify when a political committee must file certain campaign
12-finance disclosure statements.
13-BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
14-Section 1. That § 12-27-22 be AMENDED:
15-12-27-22. The treasurer of a political committee listed below shall file a campaign
16-finance disclosure statement or a report with the secretary of state as follows:
17-(1) For a candidate or candidate campaign committee for any statewide office, file a
18-pre-primary, pre-general, year-end, and, if applicable, supplemental report and
19-amendments in even numbered years and in odd numbered years, file a year -end
20-report and, if applicable, amendments;
21-(2) For a candidate or candidate campaign committee for a legislative or county office
22-with a recognized political party, file a pre-primary, a pre-general, year-end and,
23-if applicable, supplemental report and amendments in even numbered years;
24-(3) For a statewide political action committee, file a pre-primary, pre-general, year-
25-end, and, if applicable, supplemental report and amendments in even numbered
26-years and in odd numbered years, file a year -end report and, if applicable,
27-amendments;
28-(4) For a statewide political party, file a pre-primary, pre-general, year-end and, if
29-applicable, supplemental report and amendments in even numbered years and in
30-odd numbered years, file a year-end or amendments, if applicable;
31-(5) For a county political party and auxiliary organization, file a pre-general and, if
32-applicable, supplemental report and amendments in even numbered years; and
33-(6) For a statewide ballot question committee, file a pre-primary, pre-general, year-
34-end and, if applicable, supplemental report and amendments in even numbered
35-years and in odd numbered years, file a year-end and, if applicable, amendments. 25.437.13 2 17

37-The treasurer of a political committee listed in this section may submit a
38-termination report at any time.
39-If a political party loses the status of a qualified party, the party must file a
40-termination report by five p.m. central time on the last Friday in January following the
41-calendar year in which the qualified party status was lost. If a statewide ballot question
42-committee does not list any activity on the next required campaign finance report
43-submitted to the secretary of state, that committee has until the next reporting period to
44-report activity. If that committee does not have any activity to report by the next reporting
45-period, the committee must submit a termination report by that reporting period deadline.
46-A violation of this section is a Class 2 misdemeanor. A subsequent offense within
47-a calendar year is a Class 1 misdemeanor. 25.437.13 3 17

61+state by the treasurer of each committee who shall file the following financial disclosure 18
62+reports in accordance with the time frames stated in this chapter: pre -primary, pre-19
63+general, year-end, amendment, supplemental, and a termination when a committee is 20
64+terminating its existence. The treasurer of a political committee listed in this section may 21
65+submit a termination report at any time. 22
