11-ENTITLED An Act to increase civil penalties for commercial driver violations.
12-BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
13-Section 1. That § 32-12A-5.1 be AMENDED:
14-32-12A-5.1. The state's attorney for the county in which a violation of subdivision
15-32-12A-5(4) occurs shall commence a civil in rem proceeding of not more than twenty
16-thousand five hundred and thirty-seven dollars against the employer.
17-Section 2. That § 32-12A-56 be AMENDED:
18-32-12A-56. In addition to disqualification, a driver who is convicted of violating
19-an out-of-service order pursuant to § 32-12A-8.1 is subject to a civil penalty of not less
20-than three thousand nine hundred and sixty-one dollars for a first conviction and not less
21-than seven thousand nine hundred and twenty -four dollars for a second or subsequent
22-conviction.
23-Section 3. That § 32-12A-57 be AMENDED:
24-32-12A-57. The state's attorney for the county in which the violation of
25-subdivision 32-12A-5(3) occurs shall commence a civil in rem proceeding of not less than
26-seven thousand one hundred and fifty-five dollars and not more than thirty-nine thousand

17+BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA: 2
18+Section 1. That § 32-12A-5.1 be AMENDED: 3
