| 17 | 17 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA: 2 |

| 18 | 18 | | Section 1. That a NEW SECTION be added to chapter 35-4: 3 |
|---|
| 19 | 19 | | A person not licensed under this chapter may sell a vintage distilled spirit to a 4 |
|---|
| 20 | 20 | | person with an on-sale license provided in subdivision 35-4-2(4), in an amount not 5 |
|---|
| 21 | 21 | | exceeding twenty-four liters of vintage distilled spirits per on-sale licensee per year. 6 |
|---|
| 22 | 22 | | The sale of a vintage distilled spirit must occur in person on the licensed premises 7 |
|---|
| 23 | 23 | | of the on-sale licensee. 8 |

| 24 | 24 | | For purposes of this chapter, "vintage distilled spirit" means a distilled spirit that 9 |

| 25 | 25 | | has not been in distribution in this state for at least the past five years. 10 |

| 26 | 26 | | Section 2. That a NEW SECTION be added to chapter 35-4: 11 |

| 27 | 27 | | Upon purchasing a vintage distilled spirit pursuant to section 1 of this Act, the on-12 |

| 28 | 28 | | sale licensee shall place a conspicuous label on the vintage distilled spirit containing the 13 |
|---|
| 29 | 29 | | words "Vintage Distilled Spirit". 14 |
|---|
| 30 | 30 | | Prior to the sale of the vintage distilled spirit by an on-sale licensee to a consumer, 15 |
|---|
| 31 | 31 | | the on-sale licensee shall provide written notice to the Department of Revenue of the 16 |
|---|
| 32 | 32 | | purchase of the vintage distilled spirit, containing the: 17 |
|---|
| 33 | 33 | | (1) Name, address, state license number, and phone number of the on -sale licensee; 18 |
|---|
| 34 | 34 | | (2) Name, address, and phone number of the person selling the vintage distilled spirit 19 |
|---|
| 35 | 35 | | under section 1 of this Act; 20 |
|---|
| 36 | 36 | | (3) Brand name and quantity of each vintage distilled spirit purchased for resale by 21 |
|---|
| 37 | 37 | | the on-sale licensee; 22 |
|---|
| 38 | 38 | | (4) Date of purchase of the vintage distilled spirit by the on-sale licensee; and 23 |
