An Act to prevent a member of a governing body from assisting in the canvass of 1
the votes for an office for which the member is a candidate. 2
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA: 3
Section 1. That ยง 12-20-36 be AMENDED: 4
12-20-36. Within six calendar days after the close of any election, the officer in 5
charge of the election, with the assistance of a majority of the governing board as the 6
canvassing board, shall make the canvass of votes. Each member of the governing board 7
may shall name and have on file with the officer in charge of the election a person to 8
represent the member at the official canvass in the event of the member's absence for 9
cause. A member of the governing board may not assist with the canvass of the votes for 10
an office for which the member is a candidate. 11
