1818 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA: 3
1919 Section 1. That § 49-41B-11 be AMENDED: 4
2020 49-41B-11. All applicationsAn application for a permit shall must be filed with the 5
2121 Public Utilities Commission commission, not less than six months prior to the planned date 6
2222 of the commencement of construction of a facility, in such the form as prescribed by rules 7
2323 promulgated by the commission pursuant to chapter 1-26, and shall must contain, but not 8
2424 be limited to, the following information: 9
2525 (1) The name and address of the applicant; 10
2626 (2) DescriptionA description of the nature and location of the facility; 11
2727 (3) EstimatedThe estimated date of commencement of construction and duration of 12
2828 construction; 13
2929 (4) EstimatedThe estimated number of employees employed at the site of the facility 14
3030 during the construction phase and during the operating life of the facility. Estimates 15
3131 shall must include the number of employees who are to be utilized but who do not 16
3232 currently reside within the area to be affected by the facility; 17
3333 (5) FutureAny future additions and modifications to the facility, which the applicant 18
3434 may wish to be approved in the permit; 19
3535 (6) A statement of the reasons for the selection of the proposed location; 20
3636 (7) PersonThe name of the person owning the proposed facility and person managing 21
3737 the proposed facility; 22
3838 (8) The purpose of the facility; 23
3939 (9) EstimatedThe estimated consumer demand and estimated future energy needs of 24

4343 (10) The potential short and long range short-range and long-range demands on any 1
4444 estimated tax revenues generated by the facility for the extension or expansion of 2

5656 (14) Any county or municipal land use, zoning, or building rules, regulations, 14
5757 ordinances, or resolutions applicable to the facility, together with all required 15
5858 zoning and land use permits issued by a county or municipality in which the 16
5959 proposed facility is to be located. 17
