AN ACT 
 
 
ENTITLED An Act to revise provisions relating to licensing fees and license renewal 
dates for the practice of barbering and to declare an emergency. 
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA: 
Section 1. That § 36-14-22 be AMENDED: 
36-14-22. Each registered barber who continues in active practice shall annually, 
on or before May thirty-first, renew the barber's certificate of registration and pay the 
required fee. Each certificate of registration, unless renewed, expires on June first. 
Section 2. That § 36-14-24 be AMENDED: 
36-14-24. The Board of Barber Examiners shall promulgate rules, in accordance 
with chapter 1-26, to set the following fees, which may not exceed the amounts specified: 
(1) An examination to determine an applicant's fitness to receive a certificate of 
registration to practice barbering and the issuance of the certificate, three hundred 
dollars; 
(2) The annual renewal of a certificate of registration to practice barbering, three 
hundred dollars; 
(3) The restoration of an expired certificate, thirty-five dollars, plus twenty-five dollars 
for each year the certificate is expired; 
(4) A permit to operate a barber school, six hundred dollars annually; and 
(5) An annual inspection of a barbershop or barber school, one hundred fifty dollars. 
Section 3. That § 36-14-27 be AMENDED: 
36-14-27. It is a petty offense for any person to operate a barbershop unless the 
barbershop is licensed by the Board of Barber Examiners and is at all times under the 
direct supervision and management of a registered barber. Application for a license to 
operate a barbershop must be made, on forms prepared and furnished by the board,  25.197.10 	2 	28

annually before June first. The board shall promulgate rules, in accordance with chapter 
1-26, to set a fee of not more than three hundred dollars annually for each barbershop, 
plus a fee of not more than twenty dollars for each chair in the barbershop. 
Section 4. That § 36-14-29 be AMENDED: 
36-14-29. The license required by § 36-14-27 must be conspicuously displayed in 
the barbershop. A license is not transferable from person to person, location to location, 
or to a new operator at the same location. The license expires on May thirty-first each 
year. 
Section 5. That § 36-14-30 be AMENDED: 
36-14-30. After the inspection provided for in § 36-14-28, a barbershop must be 
inspected annually by the Board of Barber Examiners. The board may charge a fee for an 
annual inspection. If the barbershop does not pass the annual inspection and the inspector 
must go back to the barbershop for a subsequent inspection, the board may charge the 
barbershop owner for the cost of the subsequent inspection. 
Section 6. Whereas, this Act is necessary for the support of the state government and its 
existing public institutions, an emergency is hereby declared to exist, and this Act shall be in 
full force and effect from and after its passage and approval.  25.197.10 	3 	28
