11-ENTITLED An Act to make appropriations for water and environmental purposes and
12-to declare an emergency.
13-BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
14-Section 1. There is hereby appropriated from the South Dakota water and
15-environment fund the sum of $1,000,000, in other fund expenditure authority, to the
16-Board of Water and Natural Resources, for the purpose of providing a grant to local project
17-sponsors for a feasibility-level study, system startup, and administration of the Dakota
18-Mainstem regional water system study.
19-Moneys must be provided according to terms and conditions established by the
20-Board of Water and Natural Resources.
21-Section 2. There is hereby appropriated from the South Dakota water and
22-environment fund the sum of $2,000,000, in other fund expenditure authority, to the
23-Board of Water and Natural Resources, for the purpose of providing a grant to local project
24-sponsors for the engineering design, preconstruction activities, and construction of the
25-facilities included in the Water Investment in Northern South Dakota project.
26-Moneys must be provided according to terms and conditions established by the
27-Board of Water and Natural Resources.
28-Section 3. There is hereby appropriated from the South Dakota water and
29-environment fund the sum of $12,000,000, in other fund expenditure authority, to the
30-Board of Water and Natural Resources, for the purpose of providing grants and loans to
31-project sponsors under the state consolidated water facilities construction program,
32-established pursuant to § 46A-1-63.1.
33-Moneys must be provided according to terms and conditions established by the
34-Board of Water and Natural Resources.
35-Section 4. There is hereby appropriated from the South Dakota water and
36-environment fund the sum of $2,500,000, in other fund expenditure authority, to the
37-Board of Water and Natural Resources, for the purpose of providing grants and loans to 25.203.12 2 33

39-project sponsors under the state solid waste management program established pursuant
40-to § 46A-1-83.
41-The Department of Agriculture and Natural Resources may use up to $250,000 of
42-the funds appropriated by this section, to contract for the statewide cleanup of waste tires
43-and solid waste. Notwithstanding § 46A-1-61, the department may fund up to one
44-hundred percent of the nonfederal share of statewide waste tires and solid waste cleanup
45-projects.
46-Moneys must be provided according to terms and conditions established by the
47-Board of Water and Natural Resources.
48-Section 5. There is hereby appropriated, from administrative expense surcharge
49-fees deposited in the state water pollution control revolving fund program subfund, the
50-sum of $200,000, in other fund expenditure authority, to the Board of Water and Natural
51-Resources, for the purpose of providing water quality grants under the state water
52-pollution control revolving fund program, established pursuant to § 46A-1-60.1.
53-Moneys must be provided according to terms and conditions established by the
54-Board of Water and Natural Resources.
55-Section 6. There is hereby appropriated, from administrative expense surcharge
56-fees deposited in the state water pollution control revolving fund program subfund, the
57-sum of $300,000, in other fund expenditure authority, to the Board of Water and Natural
58-Resources, for the purpose of contracting for the preparation of applications and the
59-administration of clean water state revolving fund loans under the state water pollution
60-control revolving fund program, established pursuant to § 46A-1-60.1.
61-Moneys must be provided according to terms and conditions established by the
62-Board of Water and Natural Resources.
63-Section 7. There is hereby appropriated, from administrative expense surcharge
64-fees deposited in the state drinking water revolving fund program subfund, the sum of
65-$300,000, in other fund expenditure authority, to the Board of Water and Natural
66-Resources, for the purpose of contracting for the preparation of applications and the
67-administration of drinking water state revolving fund loans under the state drinking water
68-revolving fund program, established pursuant to § 46A-1-60.1.
69-Moneys must be provided according to terms and conditions established by the
70-Board of Water and Natural Resources.
71-Section 8. There is hereby appropriated, for federal moneys deposited in the state
72-drinking water revolving fund program subfund, the sum of $300,000, in federal fund
73-expenditure authority, to the Board of Water and Natural Resources, for the purpose of 25.203.12 3 33

75-providing small system technical assistance and local assistance set -aside grants, or
76-contracts, to eligible entities under the state drinking water revolving fund program,
77-established pursuant to § 46A-1-60.1.
78-Moneys must be provided according to terms and conditions established by the
79-Board of Water and Natural Resources.
80-Section 9. There is hereby appropriated for federal moneys deposited in the state
81-water pollution control revolving fund program subfund, the sum of $100,000, in federal
82-fund expenditure authority, to the Board of Water and Natural Resources, for the purpose
83-of providing small system technical assistance set-aside grants, or contracts, to eligible
84-entities under the state water pollution control revolving fund program, established
85-pursuant to § 46A-1-60.1.
86-Moneys must be provided according to terms and conditions established by the
87-Board of Water and Natural Resources.
88-Section 10. There is hereby appropriated the sum of $30,000,000, in federal fund
89-expenditure authority, to the Board of Water and Natural Resources, for the purpose of
90-providing grants to eligible entities for projects to address emerging contaminants in
91-drinking water under the federal emerging contaminants in small or disadvantaged
92-communities grant program.
93-Moneys must be provided according to terms and conditions established by the
94-Board of Water and Natural Resources.
95-Section 11. The secretary of the Department of Agriculture and Natural Resources
96-shall approve vouchers and the state auditor shall draw warrants to pay expenditures
97-authorized by this Act.
98-Section 12. Any amounts appropriated in this Act not lawfully expended or
99-obligated shall revert in accordance with the procedures prescribed in chapter 4-8.
100-Section 13. Whereas, this Act is necessary for the support of the state government
101-and its existing public institutions, an emergency is hereby declared to exist, and this Act
102-shall be in full force and effect from and after its passage and approval. 25.203.12 4 33
