11-ENTITLED An Act to repeal the oath requirement for an application for a lodging
12-establishment, campground, food service establishment, or mobile food
13-service establishment license.
14-BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
15-Section 1. That § 34-18-10 be AMENDED:
16-34-18-10. Every owner of a lodging establishment, campground, food service
17-establishment, or mobile food service establishment shall obtain a license before beginning
18-the operation of the establishment or campground. The license must be renewed annually
19-on or before December thirty-first. To obtain or renew a license, an owner must apply on
20-a form provided by the department, accompanied by the proper license fee.
21-The initial application form must contain:
22-(1) The name and address of the establishment or campground and previous name, if
23-changed due to a change in ownership;
24-(2) The name, address, and telephone number of the owner and operator of the
25-establishment or campground;
26-(3) A specification of the type of license applied for;
27-(4) If for a lodging establishment license, a description of the size of the establishment
28-and whether it has a water recreational facility;
29-(5) If for a campground license, a description of the size and type of the campground
30-and whether it has a water recreational facility;
31-(6) If for a food service or mobile food service establishment license, a description of
32-the size of the establishment;
33-(7) A license fee schedule; and
34-(8) A certification of consent to allow inspections of the establishment or campground
35-by authorized department inspectors during business hours upon the presentation

19+BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA: 4
20+Section 1. That § 34-18-10 be AMENDED: 5
21+34-18-10. Every owner of a lodging establishment, campground, food service 6
22+establishment, or mobile food service establishment shall annually secure obtain a license 7
23+before beginning the operation of the establishment or campground. The license must be 8
24+renewed annually on or before the first day of the license renewal period or before 9
25+beginning the operation of the establishment or campground after making proper 10
26+application December thirty-first. To obtain or renew a license, an owner must apply on a 11
27+form provided by the department, accompanied by the proper license fee. 12
28+The initial application form shall be verified under oath and shall must contain the 13
29+following: 14
30+(1) The name and address of the establishment or campground and previous name, if 15
31+changed due to a change in ownership; 16
