| 17 | 16 | | BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE: |

| 18 | 17 | | SECTION 1. Tennessee Code Annotated, Section 49-6-417, is amended by deleting the |
|---|
| 19 | 18 | | section and substituting instead the following: |

| 20 | 19 | | (a) This section is known and may be cited as the "Menstrual Hygiene Products |
|---|
| 21 | 20 | | Accessibility Act." |
|---|
| 22 | 21 | | (b) As used in this section: |
|---|
| 23 | 22 | | (1) "Eligible school" means a public school, including a public charter |
|---|
| 24 | 23 | | school, that is a senior high school, as defined in ยง 49-6-401; and |
|---|
| 25 | 24 | | (2) "Feminine hygiene product": |
|---|
| 26 | 25 | | (A) Means a product or material designed for feminine hygiene in |
|---|
| 27 | 26 | | connection with menstruation or other genital-tract secretions; and |
|---|
| 28 | 27 | | (B) Includes tampons, panty liners, menstrual cups, sanitary |
|---|
| 29 | 28 | | napkins, and other similar personal products or materials. |
|---|
| 30 | 29 | | (c) Each LEA and public charter school shall provide feminine hygiene products, |
|---|
| 31 | 30 | | at no charge, in all women's and girls' bathrooms, in all locker rooms, and with the |
|---|
| 32 | 31 | | school nurse in each eligible school building where instruction is provided, excluding |
|---|
| 33 | 32 | | bathrooms and locker rooms that are specifically designated for teacher or staff use. |
|---|
| 34 | 33 | | The feminine hygiene products provided pursuant to this section are for student use |
|---|
| 35 | 34 | | only. |
