HB 58 FISCAL NOTE Fiscal Review Committee Tennessee General Assembly January 16, 2025 Fiscal Analyst: Natalie Dusek | Email: natalie.dusek@capitol.tn.gov | Phone: 615-741-2564 HB 58 SUMMARY OF BILL: Requires law enforcement agencies (LEAs) that employ a police officer or a special deputy to contact any prior LEA that employed the person as part of the thorough investigation into the person’s good moral character. FISCAL IMPACT: NOT SIGNIFICANT Assumptions: • Pursuant to Tenn. Code Ann. § 38-8-106(8), any person employed or utilized as a full-time, part-time, temporary, reserve or auxiliary police officer, or as a special deputy must have a good moral character as determined by a thorough investigation conducted by the employing agency. • The proposed legislation specifies that should such a person have prior law enforcement experience, the employing agency must contact the person’s former employing LEA(s) during the required investigation. • It is assumed that most LEAs already contact former employers and references as part of the required thorough investigation; therefore, the proposed legislation is not estimated to result in a significant additional administrative burden. • It is further assumed that any additional phone calls or reference checks that may be required can be accomplished by state and local LEAs within existing resources without a significant increase in expenditures. • Any fiscal impact to state or local LEAs is therefore estimated to be not significant.
