13+AN ACT to amend Tennessee Code Annotated, Title 49
14+and Title 63, relative to athletic trainers.

1316 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
14-SECTION 1. Tennessee Code Annotated, Section 63-24-101 (2), is amended by deleting
15-the subdivision and substituting:
16-(2) "Athletic trainer" means a person with specific qualifications as set forth in this
17-chapter, who, upon the advice, consent, and oral or written prescription or referral of a
18-physician licensed under this title, carries out the practice of prevention, recognition,

2023 SECTION 2. Tennessee Code Annotated, Title 63, Chapter 24, is amended by adding
2124 the following as a new section:
25+ 63-24-109.
2226 (a) An athletic trainer may use dry needling, as defined in § 63-13-103, and
2327 physical modalities, such as heat, light, sound, cold, electricity, or mechanical devices,
2428 for the prevention, recognition, evaluation, management, disposition, rehabilitation, and
2529 treatment of athletic injuries.
26-(b) An athletic trainer shall only practice in those areas in which an athletic trainer
27-is competent by reason of training or experience that can be substantiated by records or
28-other evidence found acceptable by the board in the exercise of the board's considered
29-discretion.
30-(c) An athletic trainer shall obtain such training and certification in the practice of
31-dry needling as the board may require by rule. The practice of dry needling by an athletic
32-trainer under this chapter does not constitute the practice of acupuncture under chapter
33-6, part 10 of this title.
34-(d) The board is authorized to promulgate rules to effectuate this section. The
35-rules must be promulgated in accor{jance with the Uniform Administrative Procedures
36-Act, compiled in title 4, chapter 5.

3742 SECTION 3. Tennessee Code Annotated, Section 63-24-111(a), is amended by adding
3843 the following as a new subdivision:
39-(7) Establish minimum competency requirements that an athletic trainer must
44+ ( ) Establish minimum competency requirements that an athletic trainer must
4045 demonstrate in order to practice dry needling;
41-SECTION 4. Tennessee Code Annotated, Section 63-24-111, is amended by adding the
42-following as a new subsection (b) and redesignating the existing subsection (b) accordingly:
43-(b)
44-(1) The minimum competency requirements, as described in subdivision
45-(a)(7), must include:
46-(A) At least fifty (50) hours of instruction, which must include each
47-of the following areas: HB62
48-(i) Musculoskeletal and neuromuscular systems;
49-(ii) Anatomical basis of pain mechanisms, chronic pain,
50-and referral pain;
51-(iii) Trigger points; and
52-(iv) Universal precaution; and
53-(8) At least twenty-four (24) hours of dry needling specific
54-instruction, which must include each of the following areas:
55-(i) Dry needling technique;
56-(ii) Dry needling indications and contraindications;
57-(iii) Dry needling documentation;
58-(iv) Management of adverse effects;
59-(v) Practical psychomotor competency; and
60-(vi) Bloodborne pathogens protocol.
61-(2) The board shall approve the schools and organizations that provide
62-sufficient instruction to satisfy this subsection (b).
63-SECTION 5. For the purpose of promulgating rules, this act takes effect upon becoming
64-a law, the public welfare requiring it. For all other purposes, this act takes effect September 1,
65-2025, the public welfare requiring it.
