| 17 | 17 | | BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE: |

| 18 | 18 | | SECTION 1. Tennessee Code Annotated, Title 4, Chapter 11, Part 1, is amended by |
|---|
| 19 | 19 | | adding the following as a new section: |
|---|
| 20 | 20 | | (a) Notwithstanding another law to the contrary and except as provided in |
|---|
| 21 | 21 | | subsection (b), the Tennessee historical commission, and any other state entity other |
|---|
| 22 | 22 | | than the state building commission engaged in the historic preservation of real property, |
|---|
| 23 | 23 | | shall not: |
|---|
| 24 | 24 | | (1) Approve or recommend the renovation, alteration, or demolition of |
|---|
| 25 | 25 | | structural design elements of improved public or private real property that is or |
|---|
| 26 | 26 | | may be of historical, architectural, or cultural significance in this state; or |
|---|
| 27 | 27 | | (2) Take adverse action against the owner of such real property, |
|---|
| 28 | 28 | | including the assessment of a civil or other penalty or fine. |
|---|
| 29 | 29 | | (b) The Tennessee historical commission may only approve or recommend |
|---|
| 30 | 30 | | alterations or renovations to the aesthetics, non-structural elements, and building design |
|---|
| 31 | 31 | | elements of historic improved real property that is listed on the Tennessee register of |
|---|
| 32 | 32 | | historic places created pursuant to ยง 4-11-201. |
|---|
| 33 | 33 | | SECTION 2. This act takes effect upon becoming a law, the public welfare requiring it. |
