1313 AN ACT to amend Tennessee Code Annotated, Title 47,
1414 relative to speculative tickets.

1616 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
1717 SECTION 1. Tennessee Code Annotated, Section 47-50-119, is amended by deleting
1818 the section.
1919 SECTION 2. Tennessee Code Annotated, Section 47-50-121(a), is amended by adding
2020 the following as a new subdivision:
2121 ( ) "Speculative ticket":
2222 (A) Means a ticket that is not in the actual or constructive possession of a
2323 reseller at the time of sale, advertisement, or listing; and
2424 (B) Includes a ticket sold by a reseller that, at the time of resale, is not:
2525 (i) In the physical possession of the reseller;
2626 (ii) Owned by the reseller; or
2727 (iii) Under contract to be transferred to the reseller;
2828 SECTION 3. Tennessee Code Annotated, Section 47-50-121, is amended by adding
2929 the following as a new subsection:

3232 (A) A third-party ticket reseller shall not sell or offer to sell a
3333 speculative ticket.
3434 (B) A third-party ticket reseller that operates an internet website
3535 or other electronic service that provides a mechanism for two (2) or more

4040 parties to participate in a resale transaction shall not allow the sale or
4141 offering for sale of a speculative ticket.

4343 (A) The division of consumer affairs in the office of the attorney
4444 general and reporter shall enforce this subsection (e). The division shall
4545 establish a means by which a consumer may submit a complaint for a
4646 violation of this subsection.
4747 (B) If the division of consumer affairs finds that a third-party ticket
4848 reseller violated subdivision (e)(1)(A) or (e)(1)(B), then the division must
4949 assess a penalty of five thousand dollars ($5,000) per violation. Each
5050 instance of selling, offering for sale, or allowing the sale or offering for
5151 sale of a speculative ticket is a separate violation.
5252 (C) In addition to the remedy described in subdivision (e)(2)(B),
5353 an individual or entity that has reason to believe that a third-party ticket
5454 reseller violated subdivision (e)(1)(A) or (e)(1)(B) may bring a cause of
5555 action in a court of competent jurisdiction. If a court finds that the third-
5656 party ticket reseller violated subdivision (e)(1)(A) or (e)(1)(B), then the
5757 court must award the prevailing party actual damages, attorney fees, and
5858 reasonable court costs.
5959 SECTION 4. This act takes effect July 1, 2025, the public welfare requiring it, and
6060 applies to conduct occurring on or after that date.
