1312 AN ACT to amend Tennessee Code Annotated, Title 49,
1413 relative to physical activity for students.

1615 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
1716 SECTION 1. Tennessee Code Annotated, Section 49-6-1021(a), is amended by
1817 deleting the subsection and substituting:
1918 (a) In accordance with ยง 49-6-1022, each LEA shall integrate:
2019 (1) For elementary school students, a minimum of sixty (60) minutes of
2120 physical activity per full school day; and
2221 (2) For middle and high school students, a minimum of ninety (90)
2322 minutes of physical activity per full school week.
2423 SECTION 2. Tennessee Code Annotated, Section 49-6-1021(b), is amended by
2524 deleting the subsection and substituting:
2625 (b)
2726 (1) Physical activity may include walking, jumping rope, playing
2827 volleyball, or other forms of physical activity that promote fitness and well-being.
2928 Walking to and from class is not physical activity for purposes of this section.
3029 (2) To satisfy the requirements of subdivision (a)(1):
3130 (A) Physical activity:
3231 (i) Must include unstructured play outside, unless weather
3332 conditions negatively impact reasonable execution of physical
3433 activity outside; and
3534 (ii) Does not include:

4039 (a) Time during which a student is permitted to use
4140 an electronic device; or
4241 (b) Time spent by a student in a physical education
4342 class;
4443 (B) An LEA shall offer elementary students two (2) thirty-minute
4544 periods of physical activity per school day, one (1) session occurring in
4645 the morning and one (1) session occurring in the afternoon; and
4746 (C) A student shall not be withheld from participating in physical
4847 activity as a form of punishment.
4948 SECTION 3. This act takes effect July 1, 2025, the public welfare requiring it.
