| 17 | 16 | | BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE: |

| 18 | 17 | | SECTION 1. Tennessee Code Annotated, Section 49-4-1003, is amended by adding |
|---|
| 19 | 18 | | the following as new subdivisions: |
|---|
| 20 | 19 | | ( ) "Mandatory fees" means fees incurred by all students attending an |
|---|
| 21 | 20 | | educational institution; including, but not limited to: |
|---|
| 22 | 21 | | (A) Parking fees; |
|---|
| 23 | 22 | | (B) Technology fees; and |
|---|
| 24 | 23 | | (C) Library fees; |
|---|
| 25 | 24 | | ( ) "Master's degree program fees": |
|---|
| 26 | 25 | | (A) Means fees charged by an educational program or educational |
|---|
| 27 | 26 | | institution for a student to attend a master's degree program; and |
|---|
| 28 | 27 | | (B) Does not include tuition; |
|---|
| 29 | 28 | | ( ) "Undergraduate course fees": |
|---|
| 30 | 29 | | (A) Means fees charged by an educational program or educational |
|---|
| 31 | 30 | | institution for a student to attend an undergraduate course; and |
|---|
| 32 | 31 | | (B) Does not include tuition; |

| 33 | 32 | | SECTION 2. Tennessee Code Annotated, Section 49-4-1004(b), is amended by |
|---|
| 34 | 33 | | deleting the subsection and substituting instead the following: |
|---|
| 35 | 34 | | (b) Upon successful application by the eligible member attending a public |
|---|
| 36 | 35 | | educational institution, the department of military shall pay the educational institution an |
|---|
| 37 | 36 | | |

| 41 | 40 | | amount equal to one hundred percent (100%) of the maximum resident in-state tuition |

| 44 | 43 | | institution attended for the educational program to which the member successfully |

| 45 | 44 | | applied, less all other state or federal financial assistance as described in § 49-4-1005. |

| 46 | 45 | | Such financial assistance must be credited first to the member's tuition, subject to § 49- |

| 47 | 46 | | 4-1005. |

| 48 | 47 | | SECTION 3. Tennessee Code Annotated, Section 49-4-1005, is amended by adding |
|---|
| 49 | 48 | | the following as a new subdivision (9) and redesignating the current subdivision (9) and |
|---|
| 50 | 49 | | subsequent subdivisions accordingly: |

| 51 | 50 | | (9) A member is ineligible for tuition reimbursement pursuant to this part if the |
|---|
| 52 | 51 | | member is suspended from receiving federal tuition assistance due to academic |
|---|
| 53 | 52 | | performance or recoupment; |
|---|
| 54 | 53 | | SECTION 4. Tennessee Code Annotated, Section 49-4-1005(3), is amended by |
|---|
| 55 | 54 | | deleting "one hundred twenty (120) semester hours" wherever it appears and substituting "one |
|---|
| 56 | 55 | | hundred thirty (130) semester hours". |
|---|
| 57 | 56 | | SECTION 5. Tennessee Code Annotated, Section 49-4-1005(3), is amended by |
|---|
| 58 | 57 | | deleting "or eight (8) full-time equivalent semesters". |
|---|
| 59 | 58 | | SECTION 6. Tennessee Code Annotated, Section 49-4-1005(3), is amended by |
|---|
| 60 | 59 | | deleting subdivision (B), adding "or" at the end of subdivision (A), and redesignating subdivision |
|---|
| 61 | 60 | | (C) as subdivision (B). |

| 62 | 61 | | SECTION 7. Tennessee Code Annotated, Section 49-4-1005(11), is amended by |

| 63 | 62 | | deleting the subdivision and substituting: |

| 65 | 64 | | part within forty-five (45) days of course completion. |

| 72 | 71 | | SECTION 9. If a provision of this act or its application to a person or circumstance is |

| 73 | 72 | | held invalid, then the invalidity does not affect other provisions or applications of the act that can |
|---|
| 74 | 73 | | be given effect without the invalid provision or application, and to that end, the provisions of this |
|---|
| 75 | 74 | | act are severable. |
|---|
| 76 | 75 | | SECTION 10. This act takes effect upon becoming a law, the public welfare requiring it. |
