1312 AN ACT to amend Tennessee Code Annotated, Title 49,
1413 Chapter 4, Part 10, relative to tuition assistance for
1514 members of the Tennessee national guard.

1716 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
1817 SECTION 1. Tennessee Code Annotated, Section 49-4-1003, is amended by adding
1918 the following as new subdivisions:
2019 ( ) "Mandatory fees" means fees incurred by all students attending an
2120 educational institution; including, but not limited to:
2221 (A) Parking fees;
2322 (B) Technology fees; and
2423 (C) Library fees;
2524 ( ) "Master's degree program fees":
2625 (A) Means fees charged by an educational program or educational
2726 institution for a student to attend a master's degree program; and
2827 (B) Does not include tuition;
2928 ( ) "Undergraduate course fees":
3029 (A) Means fees charged by an educational program or educational
3130 institution for a student to attend an undergraduate course; and
3231 (B) Does not include tuition;
3332 SECTION 2. Tennessee Code Annotated, Section 49-4-1004(b), is amended by
3433 deleting the subsection and substituting instead the following:
3534 (b) Upon successful application by the eligible member attending a public
3635 educational institution, the department of military shall pay the educational institution an

4140 amount equal to one hundred percent (100%) of the maximum resident in-state tuition
4241 and, in an amount determined annually by the department of military's policy,
4342 undergraduate course fees or master's degree program fees charged by the educational
4443 institution attended for the educational program to which the member successfully
4544 applied, less all other state or federal financial assistance as described in § 49-4-1005.
4645 Such financial assistance must be credited first to the member's tuition, subject to § 49-
4746 4-1005.
4847 SECTION 3. Tennessee Code Annotated, Section 49-4-1005, is amended by adding
4948 the following as a new subdivision (9) and redesignating the current subdivision (9) and
5049 subsequent subdivisions accordingly:
5150 (9) A member is ineligible for tuition reimbursement pursuant to this part if the
5251 member is suspended from receiving federal tuition assistance due to academic
5352 performance or recoupment;
5453 SECTION 4. Tennessee Code Annotated, Section 49-4-1005(3), is amended by
5554 deleting "one hundred twenty (120) semester hours" wherever it appears and substituting "one
5655 hundred thirty (130) semester hours".
5756 SECTION 5. Tennessee Code Annotated, Section 49-4-1005(3), is amended by
5857 deleting "or eight (8) full-time equivalent semesters".
5958 SECTION 6. Tennessee Code Annotated, Section 49-4-1005(3), is amended by
6059 deleting subdivision (B), adding "or" at the end of subdivision (A), and redesignating subdivision
6160 (C) as subdivision (B).
6261 SECTION 7. Tennessee Code Annotated, Section 49-4-1005(11), is amended by
6362 deleting the subdivision and substituting:
6463 (11) Members must submit an application for tuition reimbursement under this
6564 part within forty-five (45) days of course completion.

7069 SECTION 8. Tennessee Code Annotated, Section 49-4-1008, is amended by deleting
7170 the section.
7271 SECTION 9. If a provision of this act or its application to a person or circumstance is
7372 held invalid, then the invalidity does not affect other provisions or applications of the act that can
7473 be given effect without the invalid provision or application, and to that end, the provisions of this
7574 act are severable.
7675 SECTION 10. This act takes effect upon becoming a law, the public welfare requiring it.
