1313 AN ACT to amend Tennessee Code Annotated, Title 33
1414 and Title 52, relative to facilities for persons with
1515 disabilities.

1717 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
1818 SECTION 1. Tennessee Code Annotated, Section 52-2-418(d)(1), is amended by
1919 deleting the second sentence and substituting:
2020 One (1) pilot participant must be located in the western grand division, as
2121 described in § 4-1-204, one (1) pilot participant must be located in the middle
2222 grand division, as described in § 4-1-203, and one (1) pilot participant must be
2323 located in the eastern grand division, as described in § 4-1-202.
2424 SECTION 2. Tennessee Code Annotated, Section 52-2-418(d)(3), is amended by
2525 adding the following new subdivision (C):
2626 (C) To be eligible to participate in the pilot program in the eastern grand division,
2727 a participant must:
2828 (i) Possess a license issued by the department to operate an existing
2929 residential home, which must be located on property:
3030 (a) In a county with a population of not less than one hundred
3131 eight thousand six hundred (108,600) and not more than one hundred
3232 eight thousand seven hundred (108,700), according to the 2020 federal
3333 census or a subsequent federal census;
3434 (b) Owned by the participant; and

3939 (c) That consists of no less than twenty-six (26) acres, which may
4040 include adjacent properties on which adults reside in an existing
4141 independent living, licensed assisted-care living, or licensed nursing
4242 home community;
4343 (ii) Offer residential services for no more than sixty (60) additional adults
4444 with intellectual and developmental disabilities;
4545 (iii) Foster an inclusive community by making available additional homes
4646 on the property for adults of all abilities equal to twenty-five percent (25%) of
4747 homes on the property; and
4848 (iv) Be recognized by the internal revenue service as an entity that is tax
4949 exempt pursuant to § 501(c)(3) of the Internal Revenue Code (26 U.S.C. §
5050 501(c)(3)), as amended.
5151 SECTION 3. Tennessee Code Annotated, Section 52-2-418(d)(4)(A)(iv), is amended by
5252 deleting the subdivision and substituting:
5353 (iv) Each bedroom contains, is adjacent to, or across the hallway from, a full
5454 bathroom facility;
5555 SECTION 4. Tennessee Code Annotated, Section 52-2-418(d)(5), is amended by
5656 deleting the subdivision and substituting:
5757 (A) The department shall accept applications for participation in a pilot program:
5858 (i) Authorized under subdivision (d)(3)(A) or (B) beginning July 1, 2024.
5959 Applications must be received on or before March 31, 2025; and
6060 (ii) Authorized under subdivision (d)(3)(C) beginning July 1, 2025.
6161 Applications must be received on or before March 31, 2026.
6262 (B) The department shall approve an application for participation in the pilot
6363 program that satisfies the requirements of subdivisions (d)(2)-(4) within thirty (30) days

6868 of receipt of the application. If an applicant proposes to build facilities in order to
6969 participate in the pilot program, then the applicant must complete the facilities necessary
7070 to participate in the pilot program on or before June 30, 2028. All pilot participants shall
7171 comply with the applicable requirements for licensure for services or facilities, as the
7272 case may be, prior to accepting residents.
7373 SECTION 5. Tennessee Code Annotated, Section 52-2-418(d)(7), is amended by
7474 adding the following sentence at the end of the subdivision:
7575 The department is not required to report outcomes for a participant under the pilot
7676 program qualified and approved under subdivision (d)(3)(C) for a reporting year until
7777 such participant's facility is operational.
7878 SECTION 6. Tennessee Code Annotated, Section 52-2-418(d)(8), is amended by
7979 deleting all language before the colon and substituting:
8080 It being the intent of the general assembly that there be one (1) pilot program
8181 participant in the western grand division, one (1) pilot program participant in the
8282 middle grand division, and one (1) pilot program participant in the eastern grand
8383 division, the department shall not
8484 SECTION 7. This act takes effect July 1, 2025, the public welfare requiring it.
