| 16 | 15 | | BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE: |

| 17 | 16 | | SECTION 1. Tennessee Code Annotated, Section 56-7-2328(a), is amended by |
|---|
| 18 | 17 | | deleting the subsection and substituting: |
|---|
| 19 | 18 | | (a) As used in this section: |
|---|
| 20 | 19 | | (1) "Contraceptive" means any device, medication, biological product, or |
|---|
| 21 | 20 | | procedure that is intended for use in the prevention of pregnancy, whether |
|---|
| 22 | 21 | | specifically intended to prevent pregnancy or for other health needs; |
|---|
| 23 | 22 | | (2) "Health benefit plan": |
|---|
| 24 | 23 | | (A) Means a hospital, surgical, or medical expense policy; health, |
|---|
| 25 | 24 | | hospital, or medical service corporation contract; a policy or agreement |
|---|
| 26 | 25 | | entered into by a health insurer, or a health maintenance organization |
|---|
| 27 | 26 | | contract offered by an employer; other plan administered by the state; or |
|---|
| 28 | 27 | | a certificate issued under those policies, contracts, or plans; and |
|---|
| 29 | 28 | | (B) Includes a policy or contract for health insurance coverage |
|---|
| 30 | 29 | | provided under: |
|---|
| 31 | 30 | | (i) The TennCare program administered under the Medical |
|---|
| 32 | 31 | | Assistance Act of 1968, compiled in title 71, chapter 5, part 1, or a |
|---|
| 33 | 32 | | successor medicaid program; or |
|---|
| 34 | 33 | | (ii) The CoverKids Act of 2006, compiled in title 71, |
|---|
| 35 | 34 | | chapter 3, part 11, or a successor program; and |
|---|
| 36 | 35 | | |

| 41 | 40 | | (C) Does not include policies or certificates covering only |
|---|
| 42 | 41 | | accident, credit, dental, disability income, long-term care, hospital |

| 44 | 43 | | Security Act (42 U.S.C. § 1395ss(g)(1)), specified disease, vision care, |
|---|
| 45 | 44 | | other limited benefit health insurance, coverage issued as a supplement |
|---|
| 46 | 45 | | to liability insurance, workers' compensation insurance, automobile |
|---|
| 47 | 46 | | medical payment insurance, or insurance under which benefits are |
|---|
| 48 | 47 | | payable with or without regard to fault and that is statutorily required to be |
|---|
| 49 | 48 | | contained in a liability insurance policy or equivalent self-insurance; |
|---|
| 50 | 49 | | (3) "Health insurance entity" has the same meaning as defined in § 56-7- |
|---|
| 51 | 50 | | 109 and includes a managed care organization contracting with the state to |
|---|
| 52 | 51 | | provide insurance through: |
|---|
| 53 | 52 | | (A) The TennCare program administered under the Medical |
|---|
| 54 | 53 | | Assistance Act of 1968, compiled in title 71, chapter 5, part 1, or a |
|---|
| 55 | 54 | | successor medicaid program; or |
|---|
| 56 | 55 | | (B) The CoverKids program administered under the CoverKids |
|---|
| 57 | 56 | | Act of 2006, compiled in title 71, chapter 3, part 11, or a successor |
|---|
| 58 | 57 | | program; and |
|---|
| 59 | 58 | | (4) "Healthcare provider" and "provider" mean a person or entity that |
|---|
| 60 | 59 | | provides healthcare services; is registered, certified, or licensed in accordance |
|---|
| 61 | 60 | | with title 63; and is regulated under the department of health or the division of |
|---|
| 62 | 61 | | health-related boards. |

| 63 | 62 | | SECTION 2. Tennessee Code Annotated, Section 56-7-2328(b), is amended by |
|---|
| 64 | 63 | | deleting "July 1, 2024" and substituting "January 1, 2026". |
