1312 AN ACT to amend Tennessee Code Annotated, Title 56
1413 and Title 71, relative to contraception.

1615 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
1716 SECTION 1. Tennessee Code Annotated, Section 56-7-2328(a), is amended by
1817 deleting the subsection and substituting:
1918 (a) As used in this section:
2019 (1) "Contraceptive" means any device, medication, biological product, or
2120 procedure that is intended for use in the prevention of pregnancy, whether
2221 specifically intended to prevent pregnancy or for other health needs;
2322 (2) "Health benefit plan":
2423 (A) Means a hospital, surgical, or medical expense policy; health,
2524 hospital, or medical service corporation contract; a policy or agreement
2625 entered into by a health insurer, or a health maintenance organization
2726 contract offered by an employer; other plan administered by the state; or
2827 a certificate issued under those policies, contracts, or plans; and
2928 (B) Includes a policy or contract for health insurance coverage
3029 provided under:
3130 (i) The TennCare program administered under the Medical
3231 Assistance Act of 1968, compiled in title 71, chapter 5, part 1, or a
3332 successor medicaid program; or
3433 (ii) The CoverKids Act of 2006, compiled in title 71,
3534 chapter 3, part 11, or a successor program; and

4140 (C) Does not include policies or certificates covering only
4241 accident, credit, dental, disability income, long-term care, hospital
4342 indemnity, medicare supplement as defined in § 1882(g)(1) of the Social
4443 Security Act (42 U.S.C. § 1395ss(g)(1)), specified disease, vision care,
4544 other limited benefit health insurance, coverage issued as a supplement
4645 to liability insurance, workers' compensation insurance, automobile
4746 medical payment insurance, or insurance under which benefits are
4847 payable with or without regard to fault and that is statutorily required to be
4948 contained in a liability insurance policy or equivalent self-insurance;
5049 (3) "Health insurance entity" has the same meaning as defined in § 56-7-
5150 109 and includes a managed care organization contracting with the state to
5251 provide insurance through:
5352 (A) The TennCare program administered under the Medical
5453 Assistance Act of 1968, compiled in title 71, chapter 5, part 1, or a
5554 successor medicaid program; or
5655 (B) The CoverKids program administered under the CoverKids
5756 Act of 2006, compiled in title 71, chapter 3, part 11, or a successor
5857 program; and
5958 (4) "Healthcare provider" and "provider" mean a person or entity that
6059 provides healthcare services; is registered, certified, or licensed in accordance
6160 with title 63; and is regulated under the department of health or the division of
6261 health-related boards.
6362 SECTION 2. Tennessee Code Annotated, Section 56-7-2328(b), is amended by
6463 deleting "July 1, 2024" and substituting "January 1, 2026".

6964 SECTION 3. This act takes effect on January 1, 2026, the public welfare requiring it.
