1414 AN ACT relative to agency rules scheduled to expire
1515 pursuant to the provisions of the Uniform
1616 Administrative Procedures Act, compiled in
1717 Tennessee Code Annotated, Title 4, Chapter 5.

1919 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
2020 SECTION 1.
2121 (a) All permanent rules filed in the office of secretary of state on or after January
2222 1, 2024, that are in effect on the effective date of this act, and that are scheduled for
2323 expiration under Tennessee Code Annotated, Section 4-5-226, on June 30, 2025, do not
2424 expire on June 30, 2025, but remain in effect until repealed or amended by subsequent
2525 rule of the appropriate rulemaking agency or until otherwise superseded by legislative
2626 enactment.
2727 (b) This section is not to be construed to justify the continued effectiveness of
2828 any rule that remains in effect under subsection (a) if the rule conflicts with the
2929 provisions of any legislative enactment other than the Uniform Administrative
3030 Procedures Act, compiled in Tennessee Code Annotated, Title 4, Chapter 5.
3131 SECTION 2. If any provision of this act or the application of any provision of this act to
3232 any person or circumstance is held invalid, then the invalidity does not affect other provisions or
3333 applications of the act that can be given effect without the invalid provision or application, and to
3434 that end, the provisions of this act are severable.
3535 SECTION 3. This act takes effect upon becoming a law, the public welfare requiring it.
