1312 AN ACT to amend Tennessee Code Annotated, Title 4 and
1413 Title 8, relative to government services.

1615 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
1716 SECTION 1. This act is known and may be cited as the "Government Serves the People
1817 Act."
1918 SECTION 2. Tennessee Code Annotated, Title 4, Chapter 3, Part 10, is amended by
2019 adding the following new section:
2120 (a) As used in this section:
2221 (1) "Agency" means a department, agency, commission, board, or other
2322 unit of state government;
2423 (2) "Commissioner" means the commissioner of finance and
2524 administration;
2625 (3) "Government service delivery" means an action by an agency related
2726 to providing a benefit or service to a state resident, business, or organization,
2827 including any such action of a contractor or nonprofit organization acting on
2928 behalf of the agency or administering a state-funded program;
3029 (4) "Government service delivery channel" means the format or medium
3130 of an interaction or transaction with an agency, including in-person, through the
3231 mail, through a digital service, by telephone, through a contact center, on a
3332 website, through outreach and communication, and through collaboration with a
3433 third party, or through other ways in which an individual or entity significantly
3534 interacts or engages with an agency; and

4039 (5) "High-impact service program" means an agency program identified
4140 by the commissioner due to the scale and impact of the public-facing services of
4241 the program.
4342 (b) The commissioner shall designate a state official as the state of Tennessee
4443 government service delivery coordinator within the department of finance and
4544 administration whose responsibility is to coordinate government-wide efforts to improve
4645 government service delivery by agencies. The coordinator shall:
4746 (1) Facilitate and coordinate government-wide efforts to improve
4847 government service delivery provided by agencies, particularly with respect to
4948 high-impact service programs;
5049 (2) Carry out the duties and powers prescribed by the commissioner;
5150 (3) Serve as the coordinating, government-wide official responsible for
5251 supporting government service delivery;
5352 (4) Advise the commissioner concerning the improvement of government
5453 service delivery provided by agencies;
5554 (5) In consultation with each lead agency service delivery official and any
5655 other agency stakeholder as appropriate, develop and oversee the
5756 implementation of government-wide government service delivery standards,
5857 policies, and guidelines for services and programs provided by agencies,
5958 including standards, policies, and guidelines to:
6059 (A) Understand the needs of an individual, business, or
6160 organization interacting with an agency;
6261 (B) Solicit and consider voluntary feedback on the government
6362 service delivery by the agency;
6463 (C) Assess government service delivery processes;

6968 (D) Consider the factors of ease, efficiency, transparency,
7069 accessibility, fairness, burden, and duration, including wait and
7170 processing times, with respect to government service delivery; and
7271 (E) Encourage the adoption of commercial products and services
7372 to measure and ensure holistic government service delivery channels and
7473 customer service satisfaction and customer experience;
7574 (6) Collect and report qualitative and quantitative information or data on
7675 government service delivery through existing reporting mechanisms;
7776 (7) Evaluate the quality of government service delivery, including through
7877 the establishment of performance metrics developed using the standards,
7978 policies, and guidelines developed pursuant to subdivision (b)(5) and the
8079 information or data collected and reported pursuant to subdivision (b)(6);
8180 (8) Engage with stakeholders to identify leading practices in service
8281 design and delivery that would improve government service delivery across and
8382 within agencies; and
8483 (9) Coordinate with other executive agency stakeholders on government
8584 service delivery.
8685 (c)
8786 (1) The commissioner shall identify each agency that must comply with
8887 this section. Each agency that is selected shall designate an official to be
8988 responsible for the government service delivery of the agency.
9089 (2) The official selected in an agency shall:
9190 (A) Possess sufficient operational authority to effectuate
9291 implementation of government service delivery improvements within the
9392 agency, particularly with respect to high impact service programs;

9897 (B) Coordinate and execute, as appropriate, under the direction of
9998 the head of the agency, and in collaboration with relevant agency officials
10099 as appropriate, efforts to improve and enhance the government service
101100 delivery and government service delivery channels of the agency;
102101 (C) At the direction of the state of Tennessee government service
103102 delivery lead, submit an implementation plan for improving agency
104103 government service delivery no later than one (1) year from the effective
105104 date of this act;
106105 (D) Coordinate the collection and reporting of the data and
107106 information required and use such data and information to improve
108107 government service delivery;
109108 (E) Facilitate collaboration among and between offices, and
110109 components within the agency and with other agencies as appropriate, in
111110 coordination with the state of Tennessee government service delivery
112111 coordinator, to improve and enhance government service delivery; and
113112 (F) Assist in the incorporation of the government service delivery
114113 requirements established under this section in agency plans, such as
115114 strategic plans or annual performance plans.
116115 (d) The commissioner or commissioner's designee shall provide an annual
117116 report to the governor and the speakers of the senate and the house of representatives
118117 on government-wide current and future efforts to improve government service delivery
119118 by agencies.
120119 SECTION 3. This act takes effect upon becoming a law, the public welfare requiring it.
