1312 AN ACT to amend Tennessee Code Annotated, Title 49,
1413 relative to virtual schools.

1615 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
1716 SECTION 1. Tennessee Code Annotated, Section 49-6-2206, is amended by adding
1817 the following as a new subsection (e) and redesignating the existing subsection (e) accordingly:

2019 (1) All virtual schools shall use a curriculum and instructional materials
2120 that meet or exceed the academic standards adopted by the state board of
2221 education. Notwithstanding subsection (a), the state board of education shall not
2322 waive this restriction for a virtual school.
2423 (2) The state textbook and instructional materials quality commission
2524 shall adopt a procedure to receive and evaluate feedback from a resident of this
2625 state that virtual school curriculum or instructional materials do not meet or
2726 exceed the academic standards adopted by the state board of education.
2827 (3) If the commission receives feedback according to the procedure
2928 established pursuant to subdivision (e)(2), then the commission shall evaluate
3029 and determine, within sixty (60) days from the date on which the feedback was
3130 received, whether the virtual school curriculum or instructional materials meet or
3231 exceed the academic standards adopted by the state board of education. The
3332 commission shall issue the commission's determination in writing to each LEA
3433 that operates a virtual school. If the textbook commission determines that a
3534 virtual school curriculum or instructional materials do not meet or exceed the

40-academic standards adopted by the state board of education, then a virtual
4140 school using that curriculum or instructional materials shall cease using such
4241 curriculum or instructional materials and substitute a curriculum and or
4342 instructional materials that meet or exceed the academic standards adopted by
4443 the state board of education.
4544 SECTION 2. This act takes effect July 1, 2025, the public welfare requiring it.
