16 | 16 | | BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE: |

17 | 17 | | SECTION 1. Tennessee Code Annotated, Title 4, Chapter 1, Part 1, is amended by |
---|
18 | 18 | | adding the following as a new section: |
---|
19 | 19 | | (a) This section is known and may be cited as the "Restrictions on International |
---|
20 | 20 | | Organizations' Jurisdiction in the State of Tennessee Act." |
---|
21 | 21 | | (b) The World Health Organization, the United Nations, and the World Economic |
---|
22 | 22 | | Forum, directly or indirectly, have no jurisdiction in this state. This state and its political |
---|
23 | 23 | | subdivisions, including, but not limited to, counties, cities, towns, precincts, water |
---|
24 | 24 | | districts, school districts, school administrative units, and quasi-public entities, must not |
---|
25 | 25 | | be compelled to engage in the enforcement of, or to collaborate with the enforcement of, |
---|
26 | 26 | | a requirement or mandate issued by the World Health Organization, the United Nations, |
---|
27 | 27 | | or the World Economic Forum, whether directly or indirectly, including, without limitation, |
---|
28 | 28 | | a government, public, or private organization acting on behalf of the World Health |
---|
29 | 29 | | Organization, World Economic Forum, or United Nations such as a national focal point; |
---|
30 | 30 | | the International Health Regulations (IHR) agreement of 2005; the United States |
---|
31 | 31 | | department of health and human services, food and drug administration, center for |
---|
32 | 32 | | disease control, or national institute of health; or other United Nations, federal, or state |
---|
33 | 33 | | One Health agencies. |
---|
34 | 34 | | (c) A requirement or mandate issued by the World Health Organization, the |
---|
35 | 35 | | United Nations, or the World Economic Forum, whether directly or indirectly, including, |
---|

---|

40 | 40 | | without limitation, a government, public, or private organization acting on behalf of the |

41 | 41 | | World Health Organization, World Economic Forum, or United Nations such as a |

42 | 42 | | national focal point; the IHR agreement of 2005; the United States department of health |
---|
43 | 43 | | and human services, food and drug administration, center for disease control, or national |
---|
44 | 44 | | institute of health; or other United Nations, federal, or state One Health agencies must |
---|
45 | 45 | | not be used in this state as a basis for action, nor to direct, order, or otherwise impose, |
---|
46 | 46 | | contrary to the Tennessee constitution and laws of this state, a requirement or mandate, |
---|
47 | 47 | | including those for masks, vaccines, or medical testing, or to gather public or private |
---|
48 | 48 | | information about the state's citizens or residents, and such a requirement or mandate |
---|
49 | 49 | | has no force or effect in this state. |
---|
50 | 50 | | (d) This state and all political subdivisions of this state, including, but not limited |
---|
51 | 51 | | to, counties, cities, towns, precincts, water districts, school districts, school |
---|
52 | 52 | | administrative units, and quasi-public entities, shall not accept any funding in support for |
---|
53 | 53 | | any programs associated with the World Health Organization, the United Nations, or the |
---|
54 | 54 | | World Economic Forum whether directly or indirectly, including, without limitation, a |
---|
55 | 55 | | government, public, or private organization acting on behalf of the World Health |
---|
56 | 56 | | Organization, World Economic Forum, or United Nations such as a national focal point; |
---|
57 | 57 | | the IHR agreement of 2005; the United States department of health and human services, |
---|
58 | 58 | | food and drug administration, center for disease control, or national institute of health; or |
---|
59 | 59 | | other United Nations, federal, or state One Health agencies. |
---|
60 | 60 | | (e) A rule, regulation, law, mandate, fee, tax policy, treaty, executive agreement, |
---|
61 | 61 | | or international agreement that violates the congressional legislative powers set forth in |
---|
62 | 62 | | Article 1, Section 8 of the United States constitution pertaining to the implementation of |
---|
63 | 63 | | mandates from the World Health Organization, World Economic Forum, or United |
---|
64 | 64 | | Nations must not be enforced or implemented by this state or an agency, department, |
---|

---|

69 | 69 | | board, commission, political subdivision, governmental entity of this state, city, county, |
---|
70 | 70 | | municipality, or another political entity. |
---|
71 | 71 | | (f) A person or entity that violates this section is subject to a civil penalty of ten |
---|
72 | 72 | | thousand dollars ($10,000) for a first offense, and twenty thousand dollars ($20,000) for |
---|
73 | 73 | | each subsequent offense. A person or entity receiving funding in violation of this section |
---|
74 | 74 | | must return such funding to the funding organization. |
---|
75 | 75 | | SECTION 2. This act takes effect upon becoming a law, the public welfare requiring it. |
