1313 AN ACT to amend Tennessee Code Annotated, Title 66,
1414 relative to leases.

1616 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
1717 SECTION 1. Tennessee Code Annotated, Title 66, Chapter 7, is amended by adding
1818 the following as a new section:
1919 66-7-113.
2020 (a) On and after July 1, 2025, a landlord shall not prohibit a tenant or a tenant's
2121 guest from lawfully possessing, carrying, transporting, or storing a firearm, any part of a
2222 firearm, or firearm ammunition in the tenant's home, apartment, or business; in a vehicle
2323 located in a parking area provided for tenants or tenants' guests by the landlord of the
2424 leased premises; or in other locations controlled by the landlord as necessary to enter or
2525 exit the tenant's home, apartment, or business, to enter or exit the leased premises, or to
2626 enter or exit a vehicle located on the leased premises or in a parking area provided by
2727 the landlord for tenants or tenants' guests.

2929 (1) An existing lease that is in effect on July 1, 2025, that contains lease
3030 terms relative to firearms that are in violation of subsection (a) may, for purposes
3131 of other lease terms that do not violate subsection (a), remain in effect and must
3232 be amended to comply with subsection (a) prior to July 1, 2026. However, on
3333 and after July 1, 2025, any such lease terms relative to firearms that are in
3434 violation of subsection (a) are void and unenforceable.

3939 (2) An existing lease described in subdivision (b)(1) is not in violation of
4040 subsection (a) until July 1, 2026, as long as the lease terms relative to firearms
4141 that are in violation of subsection (a) are not enforced and the lease is amended
4242 to comply with subsection (a) prior to July 1, 2026.
4343 (3) This subsection (b) does not prohibit a landlord and tenant from
4444 voluntarily entering into a new lease agreement prior to July 1, 2026, to replace
4545 an existing lease that contains lease terms relative to firearms that are in
4646 violation of subsection (a).
4747 (c) A tenant who is adversely affected by a violation of subsection (a) may bring
4848 a suit against the landlord for actual damages, punitive damages, and recovery of
4949 attorney fees.
5050 SECTION 2. Tennessee Code Annotated, Title 66, Chapter 28, Part 2, is amended by
5151 adding the following as a new section:
5252 66-28-206.
5353 (a) On and after July 1, 2025, a landlord shall not prohibit a tenant or a tenant's
5454 guest from lawfully possessing, carrying, transporting, or storing a firearm, any part of a
5555 firearm, or firearm ammunition in the tenant's home, apartment, or business; in a vehicle
5656 located in a parking area provided for tenants or tenants' guests by the landlord of the
5757 leased premises; or in other locations controlled by the landlord as necessary to enter or
5858 exit the tenant's home, apartment, or business, to enter or exit the leased premises, or to
5959 enter or exit a vehicle located on the leased premises or in a parking area provided by

6262 (1) An existing lease that is in effect on July 1, 2025, that contains lease

7070 and after July 1, 2025, any such lease terms relative to firearms that are in
7171 violation of subsection (a) are void and unenforceable.
7272 (2) An existing lease described in subdivision (b)(1) is not in violation of
7373 subsection (a) until July 1, 2026, as long as the lease terms relative to firearms
7474 that are in violation of subsection (a) are not enforced and the lease is amended
7575 to comply with subsection (a) prior to July 1, 2026.
7676 (3) This subsection (b) does not prohibit a landlord and tenant from
7777 voluntarily entering into a new lease agreement prior to July 1, 2026 to replace
7878 an existing lease that contains lease terms relative to firearms that are in
7979 violation of subsection (a).
8080 (c) A tenant who is adversely affected by a violation of subsection (a) may bring
8181 a suit against the landlord for actual damages, punitive damages, and recovery of

8383 SECTION 3 Tennessee Code Annotated, Section 66-28-402(a), is amended by adding
8484 the following new subdivision:
8585 (7) The rule or regulation does not violate ยง 66-28-206.
8686 SECTION 4. This act takes effect July 1, 2025, the public welfare requiring it.
