| 16 | 15 | | BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE: |

| 17 | 16 | | SECTION 1. Tennessee Code Annotated, Section 39-17-1324, is amended by deleting |
|---|
| 18 | 17 | | subdivision (i)(1) and substituting: |
|---|
| 19 | 18 | | (1) "Dangerous felony" means: |
|---|
| 20 | 19 | | (A) First degree murder, as defined in § 39-13-202; |
|---|
| 21 | 20 | | (B) Second degree murder, as defined in § 39-13-210; |
|---|
| 22 | 21 | | (C) Voluntary manslaughter, as defined in § 39-13-211; |
|---|
| 23 | 22 | | (D) Criminally negligent homicide, as defined in § 39-13-212; |
|---|
| 24 | 23 | | (E) Reckless homicide, as defined in § 39-13-215; |
|---|
| 25 | 24 | | (F) Aggravated kidnapping, as defined in § 39-13-304; |
|---|
| 26 | 25 | | (G) Especially aggravated kidnapping, as defined in § 39-13-305; |
|---|
| 27 | 26 | | (H) Involuntary labor servitude, as defined in § 39-13-307; |
|---|
| 28 | 27 | | (I) Trafficking for forced labor or services, as defined in § 39-13-308; |
|---|
| 29 | 28 | | (J) Trafficking for commercial sex acts, as defined in § 39-13-309; |
|---|
| 30 | 29 | | (K) Aggravated human trafficking, as defined in § 39-13-316; |
|---|
| 31 | 30 | | (L) Robbery, as defined in § 39-13-401; |
|---|
| 32 | 31 | | (M) Aggravated robbery, as defined in § 39-13-402; |

| 49 | 48 | | (Z) Aggravated stalking, as defined in § 39-17-315(c); |

| 50 | 49 | | (AA) Especially aggravated stalking, as defined in § 39-17-315(d); |
|---|
| 51 | 50 | | (BB) Initiating the process intended to manufacture methamphetamine, |
|---|
| 52 | 51 | | as defined in § 39-17-435; |
|---|
| 53 | 52 | | (CC) A felony involving the sale, manufacture, distribution, or possession |
|---|
| 54 | 53 | | with intent to sell, manufacture, or distribute a controlled substance or controlled |
|---|
| 55 | 54 | | substance analogue, as defined in part 4 of this chapter; or |
|---|
| 56 | 55 | | (DD) Any attempt, as defined in § 39-12-101, to commit a dangerous |
|---|
| 57 | 56 | | felony; |
|---|
| 58 | 57 | | SECTION 2. Tennessee Code Annotated, Section 39-17-1324, is amended by |
|---|
| 59 | 58 | | designating subsection (d) as subdivision (d)(1) and adding the following subdivision (d)(2): |
|---|
| 60 | 59 | | (2) A lesser included offense of the predicate dangerous felony named in |
|---|
| 61 | 60 | | the indictment or presentment is included in the indictment or presentment by |
|---|
| 62 | 61 | | implication if the lesser included offense is a dangerous felony, as defined in |
|---|
| 63 | 62 | | subdivision (i)(1). |
|---|
| 64 | 63 | | SECTION 3. This act takes effect July 1, 2025, the public welfare requiring it. |
