1313 AN ACT to amend Tennessee Code Annotated, Title 63,
1414 Chapter 24 relative to athletic trainers.

1616 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
1717 SECTION 1. Tennessee Code Annotated, Section 63-24-101, is amended by deleting
1818 the section and substituting:
1919 As used in this chapter:
2020 (1) "Athletic injury" means any injury or condition that limits or prevents a
2121 person's participation in exercises, sports, games, or recreation, or other
2222 activities requiring physical strength, agility, flexibility, range of motion, speed, or
2323 stamina or a condition that prevents the person from participating in such
2424 activities;
2525 (2) "Athletic trainer" means a healthcare provider with the qualifications
2626 prescribed in this chapter who, upon the advice, consent, and oral or written
2727 prescriptions or referrals of a physician licensed under this title, carries out the
2828 practice of prevention, recognition, evaluation, management, disposition,
2929 treatment, or rehabilitation of athletic injuries, and, in carrying out such functions
3030 is authorized to use manual techniques; physical modalities, such as heat, light,
3131 sound, cold, electricity, or therapeutic devices; and healthcare procedures related
3232 to prevention, recognition, evaluation, management, disposition, rehabilitation,
3333 and treatment; athletic trainers shall practice only in areas they are competent,
3434 by reason of training or experience that can be substantiated by records or other

3939 evidence deemed acceptable by the board in the exercise of the board's
4040 discretion;
4141 (3) "Board" means the board of athletic trainers;
4242 (4) "Board of Certification" or "BOC" means the Board of Certification for
4343 the Athletic Trainer, Inc.; and
4444 (5) "Healthcare procedures" means a course of action intended to
4545 achieve a result in the delivery of health care, including rectal core thermometer
4646 administration, blood glucose monitoring, injection administration, wound closure,
4747 dry needling application, and intravenous fluid administration.
4848 SECTION 2. Tennessee Code Annotated, Section 63-24-103, is amended by deleting
4949 the section and substituting:
5050 (a) A person shall not represent themselves or claim to be an athletic trainer or
5151 perform any of the activities of an athletic trainer without first obtaining a license under
5252 this chapter.
5353 (b) This chapter does not prevent a person from serving as an athletic training
5454 student, or a similar position if such service is not primarily for compensation and is
5555 carried out under the supervision of a licensed athletic trainer and a physician licensed
5656 under chapter 6 or chapter 9 of this title. Such supervision must be provided under the
5757 guidelines of the Board of Certification and approved by the board.
5858 SECTION 3. Tennessee Code Annotated, Section 63-24-104(a)(2), is amended by
5959 deleting the subdivision and substituting:
6060 (2) Satisfactorily completed all of the Board of Certification qualifications and be
6161 certified as an athletic trainer in good standing by the BOC and approved by the board.
6262 SECTION 4. Tennessee Code Annotated, Section 63-24-104(b), is amended by
6363 deleting the language:

6868 An out-of-state applicant from a state not having a licensure or certification act
6969 will be eligible to take the jurisprudence examination if certified by the NATA
7070 Board of Certification, Inc., and approved by the board.
7171 and substituting:
7272 An out-of-state applicant from a state not having a current licensure or
7373 certification act or an expired license or certificate in good standing at time of
7474 expiration will be eligible to take the jurisprudence examination if certified by the
7575 Board of Certification and approved by the board.
7676 SECTION 5. Tennessee Code Annotated, Section 63-24-105(a)(2), is amended by
7777 deleting the subdivision and substituting:
7878 (2) The applicant is entitled to an athletic trainer's license if the applicant
7979 possesses the qualifications enumerated in § 63-24-104; completes and passes the
8080 certification requirements and examination of the Board of Certification or its equivalent
8181 as determined by the board; completes the jurisprudence examination administered and
8282 selected by the board, to its satisfaction; pays the licensure fee as prescribed in § 63-24-
8383 106; and has not committed an act that constitutes grounds for denial of a license under
8484 § 63-24-107.
8585 SECTION 6. This act takes effect upon becoming a law, the public welfare requiring it.
