16 | 16 | | BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE: |

17 | 17 | | SECTION 1. Tennessee Code Annotated, Section 63-24-101, is amended by deleting |
---|
18 | 18 | | the section and substituting: |
---|
19 | 19 | | As used in this chapter: |
---|
20 | 20 | | (1) "Athletic injury" means any injury or condition that limits or prevents a |
---|
21 | 21 | | person's participation in exercises, sports, games, or recreation, or other |
---|
22 | 22 | | activities requiring physical strength, agility, flexibility, range of motion, speed, or |
---|
23 | 23 | | stamina or a condition that prevents the person from participating in such |
---|
24 | 24 | | activities; |
---|
25 | 25 | | (2) "Athletic trainer" means a healthcare provider with the qualifications |
---|
26 | 26 | | prescribed in this chapter who, upon the advice, consent, and oral or written |
---|
27 | 27 | | prescriptions or referrals of a physician licensed under this title, carries out the |
---|
28 | 28 | | practice of prevention, recognition, evaluation, management, disposition, |
---|
29 | 29 | | treatment, or rehabilitation of athletic injuries, and, in carrying out such functions |
---|
30 | 30 | | is authorized to use manual techniques; physical modalities, such as heat, light, |
---|
31 | 31 | | sound, cold, electricity, or therapeutic devices; and healthcare procedures related |
---|
32 | 32 | | to prevention, recognition, evaluation, management, disposition, rehabilitation, |
---|
33 | 33 | | and treatment; athletic trainers shall practice only in areas they are competent, |
---|
34 | 34 | | by reason of training or experience that can be substantiated by records or other |
---|
35 | 35 | | |

39 | 39 | | evidence deemed acceptable by the board in the exercise of the board's |
---|
40 | 40 | | discretion; |
---|
41 | 41 | | (3) "Board" means the board of athletic trainers; |
---|
42 | 42 | | (4) "Board of Certification" or "BOC" means the Board of Certification for |
---|
43 | 43 | | the Athletic Trainer, Inc.; and |
---|
44 | 44 | | (5) "Healthcare procedures" means a course of action intended to |
---|
45 | 45 | | achieve a result in the delivery of health care, including rectal core thermometer |
---|
46 | 46 | | administration, blood glucose monitoring, injection administration, wound closure, |
---|
47 | 47 | | dry needling application, and intravenous fluid administration. |
---|
48 | 48 | | SECTION 2. Tennessee Code Annotated, Section 63-24-103, is amended by deleting |
---|
49 | 49 | | the section and substituting: |
---|
50 | 50 | | (a) A person shall not represent themselves or claim to be an athletic trainer or |
---|
51 | 51 | | perform any of the activities of an athletic trainer without first obtaining a license under |
---|
52 | 52 | | this chapter. |
---|
53 | 53 | | (b) This chapter does not prevent a person from serving as an athletic training |
---|
54 | 54 | | student, or a similar position if such service is not primarily for compensation and is |
---|
55 | 55 | | carried out under the supervision of a licensed athletic trainer and a physician licensed |
---|
56 | 56 | | under chapter 6 or chapter 9 of this title. Such supervision must be provided under the |
---|
57 | 57 | | guidelines of the Board of Certification and approved by the board. |
---|
58 | 58 | | SECTION 3. Tennessee Code Annotated, Section 63-24-104(a)(2), is amended by |
---|
59 | 59 | | deleting the subdivision and substituting: |
---|
60 | 60 | | (2) Satisfactorily completed all of the Board of Certification qualifications and be |
---|
61 | 61 | | certified as an athletic trainer in good standing by the BOC and approved by the board. |
---|
62 | 62 | | SECTION 4. Tennessee Code Annotated, Section 63-24-104(b), is amended by |
---|

72 | 72 | | An out-of-state applicant from a state not having a current licensure or |
---|
73 | 73 | | certification act or an expired license or certificate in good standing at time of |
---|
74 | 74 | | expiration will be eligible to take the jurisprudence examination if certified by the |
---|
75 | 75 | | Board of Certification and approved by the board. |
---|
76 | 76 | | SECTION 5. Tennessee Code Annotated, Section 63-24-105(a)(2), is amended by |
---|
77 | 77 | | deleting the subdivision and substituting: |
---|
78 | 78 | | (2) The applicant is entitled to an athletic trainer's license if the applicant |
---|
79 | 79 | | possesses the qualifications enumerated in § 63-24-104; completes and passes the |
---|
80 | 80 | | certification requirements and examination of the Board of Certification or its equivalent |
---|
81 | 81 | | as determined by the board; completes the jurisprudence examination administered and |
---|
82 | 82 | | selected by the board, to its satisfaction; pays the licensure fee as prescribed in § 63-24- |
---|
83 | 83 | | 106; and has not committed an act that constitutes grounds for denial of a license under |
---|
84 | 84 | | § 63-24-107. |
---|
85 | 85 | | SECTION 6. This act takes effect upon becoming a law, the public welfare requiring it. |
---|
