| 15 | 15 | | BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE: |

| 16 | 16 | | SECTION 1. Tennessee Code Annotated, Section 44-2-102, is amended by deleting |
|---|
| 17 | 17 | | subdivision (4) and substituting: |
|---|
| 18 | 18 | | (4) |
|---|
| 19 | 19 | | (A) Recommend tests or vaccinations of animals within this state or |
|---|
| 20 | 20 | | imported into this state for the purpose of protecting the health of animals in this |
|---|
| 21 | 21 | | state; and |
|---|
| 22 | 22 | | (B) Order tests or vaccinations of animals within this state or imported |
|---|
| 23 | 23 | | into this state for the purpose of protecting the health of animals in this state, if |
|---|
| 24 | 24 | | each specific vaccination and test ordered has received prior approval from the |
|---|
| 25 | 25 | | joint government operations committee of the house of representatives and the |
|---|
| 26 | 26 | | senate. In the event of a disease outbreak during a state of emergency declared |
|---|
| 27 | 27 | | by the governor, the governor may temporarily approve tests and vaccinations for |
|---|
| 28 | 28 | | animals that the commissioner and state veterinarian may order without prior |
|---|
| 29 | 29 | | approval from the joint government operations committee; |
|---|
| 30 | 30 | | SECTION 2. Tennessee Code Annotated, Section 44-2-102, is amended by deleting |
|---|
| 31 | 31 | | subdivision (6). |
|---|
| 32 | 32 | | SECTION 3. Tennessee Code Annotated, Section 44-2-105, is amended by deleting the |
|---|
| 33 | 33 | | section and substituting instead: |
|---|
| 34 | 34 | | The commissioner, through rules, shall establish procedures for the payment of |
|---|
| 35 | 35 | | indemnities for animals destroyed under the authority of this chapter. Indemnity under |
