1313 AN ACT to amend Tennessee Code Annotated, Title 39,
1414 relative to criminal offenses.

1616 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
1717 SECTION 1. Tennessee Code Annotated, Title 39, Chapter 17, Part 10, is amended by
1818 adding the following new section:
1919 (a)
2020 (1) It is an offense for a person to knowingly possess, distribute, or
2121 produce technology, software, or digital tools designed for the purpose of
2222 creating material that includes a minor engaged in:
2323 (A) Sexual activity; or
2424 (B) Simulated sexual activity that is patently offensive.

2626 (A) Possession of technology, software, or digital tools in violation
2727 of subdivision (a)(1) is a Class E felony.
2828 (B) Distribution of technology, software, or digital tools in violation
2929 of subdivision (a)(1) is a Class C felony.
3030 (C) Production of technology, software, or digital tools in violation
3131 of subdivision (a)(1) is a Class B felony.
3232 (b) In determining whether technology, software, or digital tools are designed for
3333 the purpose of creating material that includes a minor engaged in sexual activity or
3434 simulated sexual activity that is patently offensive, the court or other authority making

3939 that determination shall, in addition to all other logically relevant factors, consider the
4040 following:
4141 (1) Statements by the defendant concerning its use;
4242 (2) The existence of material that includes a minor engaged in sexual
4343 activity or simulated sexual activity that is patently offensive in the defendant's
4444 possession;
4545 (3) Instructions, oral or written, provided with the technology, software, or
4646 digital tools concerning its use;
4747 (4) Descriptive materials accompanying the technology, software, or
4848 digital tools that explain or depict its use;
4949 (5) The manner in which the technology, software, or digital tools were
5050 advertised or offered when obtained by the defendant;
5151 (6) The existence and scope of legitimate uses for the technology,
5252 software, or digital tools in the community; and
5353 (7) Expert testimony concerning use of the technology, software, or
5454 digital tools.
5555 SECTION 2. This act takes effect July 1, 2025, the public welfare requiring it.
