13	12		AN ACT to amend Tennessee Code Annotated, Title 4,
14	13		Chapter 3; Title 4, Chapter 49; Section 9-16-101;
15	14		Title 54, Chapter 4; Title 55, Chapter 4; Title 57,
16	15		Chapter 5, Part 2; Title 57, Chapter 3, Part 3; Title
17	16		67, Chapter 3, Part 9; Title 67, Chapter 4, Part 9
18	17		and Title 67, relative to allocations to counties and
19	18		municipalities.

21	20		BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
22	21		SECTION 1. Tennessee Code Annotated, Section 67-6-103(a)(3)(A), is amended by
23	22		adding the language "and according to subdivision (a)(3)(G)" immediately after the language
24	23		"according to the latest federal census and other censuses authorized by law".
25	24		SECTION 2. Tennessee Code Annotated, Section 67-6-103(a)(3), is amended by
26	25		adding the following as a new subdivision (G):
27	26		Notwithstanding the right or ability of a county or municipality to take a special
28	27		census at any time during the interim between the regular decennial federal census
29	28		under this section or another law, the department of economic and community
30	29		development shall revise and certify the population of each county and municipality, and
31	30		the aggregate population of the state, prior to July 1 each year during the interim
32	31		between the regular decennial federal census according to this subdivision (a)(3)(G) for
33	32		purposes of ensuring equitable allocation and distribution of moneys under this
34	33		subdivision (a)(3). The Boyd Center for Business and Economic Research at the
35	34		University of Tennessee, through the Tennessee state data center, shall generate
36	35		annual population estimates for each county and municipality and provide the estimates
37	36		to the department of economic and community development for review and certification.
38	37		Prior to July 1, the department of economic and community development shall provide

43	42		the revised, certified populations of each county and municipality to the department of
44	43		revenue and the department of finance and administration. The allocation and
45	44		distribution of moneys pursuant to this subdivision (a)(3) must be made according to the
46	45		revised populations certified under this subdivision (a)(3)(G), except in instances where
47	46		a jurisdiction's population is revised as a result of a special census or in a year in which
48	47		populations are revised as a result of the regular decennial federal census.
49	48		SECTION 3. Tennessee Code Annotated, Section 67-6-103(j)(4), is amended by adding
50	49		the language "or according to subdivision (a)(3)(G)" immediately after the language "according
51	50		to the latest federal census or other censuses authorized by law".
52	51		SECTION 4. Tennessee Code Annotated, Title 4, Chapter 3, Part 7, is amended by
53	52		adding the following as a new section:
54	53		4-3-710.
55	54		(a) Notwithstanding the right or ability of a county or municipality to take a
56	55		special census during the interim between the regular decennial federal census, the
57	56		department of economic and community development shall revise and certify the
58	57		population of each county and municipality, and the aggregate population of the state,
59	58		prior to July 1 each year during the interim between the regular decennial federal census
60	59		according to this section for purposes of ensuring equitable population-based allocation
61	60		and distribution of moneys to counties and municipalities.
62	61		(b) The Boyd Center for Business and Economic Research at the University of
63	62		Tennessee, through the Tennessee state data center, shall generate annual population

65	64		of economic and community development for review and certification.
66	65		(c) Prior to July 1, the department of economic and community development

73	72		and distribution of moneys to counties and municipalities must be made according to the

77	76		SECTION 5. Tennessee Code Annotated, Title 67, Chapter 1, Part 1, is amended by
78	77		adding the following as a new section:
79	78		67-1-119.
80	79		Notwithstanding another law to the contrary, the allocation and distribution of
81	80		moneys to counties and municipalities under this title, title 54, title 55, or title 57 based
82	81		on population must be made according to the revised populations certified by the
83	82		department of economic and community development under § 4-3-710, except in
84	83		instances where a jurisdiction's population is revised as a result of a special census or in
85	84		a year in which populations are revised as a result of the regular decennial federal
86	85		census.
87	86		SECTION 6. Tennessee Code Annotated, Title 4, Chapter 3, Part 10, is amended by
88	87		adding the following as a new section:
89	88		4-3-1015.
90	89		Except as otherwise expressly provided by law, the allocation and distribution of
91	90		moneys to counties and municipalities based on population must be made according to
92	91		the revised populations certified by the department of economic and community
93	92		development under § 4-3-710, except in instances where a jurisdiction's population is
94	93		revised as a result of a special census or in a year in which populations are revised as a
95	94		result of the regular decennial federal census.

100	99		SECTION 7. Tennessee Code Annotated, Section 4-49-104(e)(2), is amended by
101	100		addling the following language at the end of the subdivision:
102	101		Notwithstanding another law to the contrary, the allocation and distribution of moneys to
103	102		counties and municipalities under this subdivision (e)(2) must be made according to the
104	103		revised populations certified by the department of economic and community
105	104		development under § 4-3-710, except in instances where a jurisdiction's population is
106	105		revised as a result of a special census or in a year in which populations are revised as a
107	106		result of the regular decennial federal census.
108	107		SECTION 8. This act takes effect January 1, 2026, the public welfare requiring it.
