1312 AN ACT to amend Tennessee Code Annotated, Title 4,
1413 Chapter 3; Title 4, Chapter 49; Section 9-16-101;
1514 Title 54, Chapter 4; Title 55, Chapter 4; Title 57,

2120 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
2221 SECTION 1. Tennessee Code Annotated, Section 67-6-103(a)(3)(A), is amended by
2322 adding the language "and according to subdivision (a)(3)(G)" immediately after the language
2423 "according to the latest federal census and other censuses authorized by law".
2524 SECTION 2. Tennessee Code Annotated, Section 67-6-103(a)(3), is amended by
2625 adding the following as a new subdivision (G):
2726 Notwithstanding the right or ability of a county or municipality to take a special
2827 census at any time during the interim between the regular decennial federal census
2928 under this section or another law, the department of economic and community
3029 development shall revise and certify the population of each county and municipality, and
3130 the aggregate population of the state, prior to July 1 each year during the interim
3231 between the regular decennial federal census according to this subdivision (a)(3)(G) for
3332 purposes of ensuring equitable allocation and distribution of moneys under this
3433 subdivision (a)(3). The Boyd Center for Business and Economic Research at the
3534 University of Tennessee, through the Tennessee state data center, shall generate
3635 annual population estimates for each county and municipality and provide the estimates
3736 to the department of economic and community development for review and certification.
3837 Prior to July 1, the department of economic and community development shall provide

4342 the revised, certified populations of each county and municipality to the department of
4443 revenue and the department of finance and administration. The allocation and
4544 distribution of moneys pursuant to this subdivision (a)(3) must be made according to the
4645 revised populations certified under this subdivision (a)(3)(G), except in instances where
4746 a jurisdiction's population is revised as a result of a special census or in a year in which
4847 populations are revised as a result of the regular decennial federal census.
4948 SECTION 3. Tennessee Code Annotated, Section 67-6-103(j)(4), is amended by adding
5049 the language "or according to subdivision (a)(3)(G)" immediately after the language "according
5150 to the latest federal census or other censuses authorized by law".
5251 SECTION 4. Tennessee Code Annotated, Title 4, Chapter 3, Part 7, is amended by
5352 adding the following as a new section:
5453 4-3-710.
5554 (a) Notwithstanding the right or ability of a county or municipality to take a
5655 special census during the interim between the regular decennial federal census, the
5756 department of economic and community development shall revise and certify the
5857 population of each county and municipality, and the aggregate population of the state,
5958 prior to July 1 each year during the interim between the regular decennial federal census
6059 according to this section for purposes of ensuring equitable population-based allocation
6160 and distribution of moneys to counties and municipalities.
6261 (b) The Boyd Center for Business and Economic Research at the University of
6362 Tennessee, through the Tennessee state data center, shall generate annual population
6463 estimates for each county and municipality and provide the estimates to the department
6564 of economic and community development for review and certification.
6665 (c) Prior to July 1, the department of economic and community development
6766 shall provide the revised, certified populations of each county and municipality to the

7776 SECTION 5. Tennessee Code Annotated, Title 67, Chapter 1, Part 1, is amended by
7877 adding the following as a new section:

8079 Notwithstanding another law to the contrary, the allocation and distribution of
8180 moneys to counties and municipalities under this title, title 54, title 55, or title 57 based
8281 on population must be made according to the revised populations certified by the
8382 department of economic and community development under § 4-3-710, except in
8483 instances where a jurisdiction's population is revised as a result of a special census or in
8584 a year in which populations are revised as a result of the regular decennial federal
8685 census.
8786 SECTION 6. Tennessee Code Annotated, Title 4, Chapter 3, Part 10, is amended by
8887 adding the following as a new section:
8988 4-3-1015.
9089 Except as otherwise expressly provided by law, the allocation and distribution of
9190 moneys to counties and municipalities based on population must be made according to
9291 the revised populations certified by the department of economic and community
9392 development under § 4-3-710, except in instances where a jurisdiction's population is
9493 revised as a result of a special census or in a year in which populations are revised as a
9594 result of the regular decennial federal census.

10099 SECTION 7. Tennessee Code Annotated, Section 4-49-104(e)(2), is amended by
101100 addling the following language at the end of the subdivision:
102101 Notwithstanding another law to the contrary, the allocation and distribution of moneys to
103102 counties and municipalities under this subdivision (e)(2) must be made according to the
104103 revised populations certified by the department of economic and community
105104 development under § 4-3-710, except in instances where a jurisdiction's population is
106105 revised as a result of a special census or in a year in which populations are revised as a
107106 result of the regular decennial federal census.
108107 SECTION 8. This act takes effect January 1, 2026, the public welfare requiring it.
