13+AN ACT to amend Tennessee Code Annotated, Title 7,
14+Chapter 51; Title 39 and Title 65, Chapter 15,
15+relative to vehicles for hire.

1417 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
15-SECTION 1. Tennessee Code Annotated, Title 65, Chapter 15, Part 3, is amended by adding
16-the following as a new section:
18+ SECTION 1. Tennessee Code Annotated, Title 65, Chapter 15, Part 3, is amended by
19+adding the following as a new section:
1720 65-15-312. Criminal impersonation of a transportation network company driver.
18-(a) A person commits an offense who, with intent to deceive:
19-(1) Impersonates a transportation network company driver by making a false
20-statement, using a false display of distinctive signage or emblem known as a trade
21-dress, trademark, branding, or logo of the transportation network company, or
22-commits another act that falsely represents that the person has a current connection
23-with a transportation network company; or
24-(2) Falsely represents that the person is responding to a passenger ride
21+ (a) It is an offense for a person to:
22+ (1) Impersonate a transportation network company driver by making a
23+false statement, using a false display of distinctive signage or emblem known as
24+a trade dress, trademark, branding, or logo of the transportation network
25+company, or committing another act that falsely represents that the person has a
26+current connection with a transportation network company; or
27+ (2) Falsely represent that the person is responding to a passenger ride
2528 request for a transportation network company.
2629 (b) A violation of subsection (a) is a Class B misdemeanor; provided, that if the
2730 violation occurs during the commission of a separate felony offense, then a violation of
2831 subsection (a) is a Class E felony.
29-SECTION 2. Tennessee Code Annotated, Title 7, Chapter 51, Part 10, is amended by adding

33+adding the following as a new section:
3134 7-51-1009. Criminal impersonation of a private passenger-for-hire vehicle driver.
3235 (a) As used in this section, a "passenger-for-hire vehicle":
3336 (1) Means a motor vehicle that:
34-(A) Is designed or constructed to accommodate and transport not more
35-than fourteen (14) passengers for hire, exclusive of the driver;

41+ (A) Is designed or constructed to accommodate and transport not
42+more than fourteen (14) passengers for hire, exclusive of the driver;
3643 (B) Principally operates within the corporate limits of cities and
3744 suburban territory adjacent to the cities; and
3845 (C) That is not operated on a fixed route or schedule;
39-(2) Includes a taxicab, limousine, or sedan, as defined in§ 7-51-1007; and
46+ (2) Includes a taxicab, limousine, or sedan, as defined in § 7-51-1007;

4048 (3) Does not include a personal vehicle used in conjunction with a
4149 transportation network company under title 65, chapter 15, part 3.
42-(b) A person commits an offense who, with intent to deceive: SB 704
43-(1) Impersonates a passenger-for-hire vehicle driver by making a false
44-statement, using a false display of distinctive signage or emblem known as a trade
45-dress, trademark, branding, or logo of a passenger-for-hire vehicle, or commits
46-another act that falsely represents that the person has a current connection with a

51+ (1) Impersonate a passenger-for-hire vehicle driver by making a false

53+trade dress, trademark, branding, or logo of a passenger-for-hire vehicle, or any

5058 (c) A violation of subsection (b) is a Class B misdemeanor.
51-(d) If theft of a passenger-for-hire vehicle has occurred as described in§ 39-14-103,
52-then this section does not apply to the owner of the passenger-for-hire vehicle.
53-SECTION 3. The headings in this act are for reference purposes only and do not constitute a
54-part of the law enacted by this act. However, the Tennessee Code Commission is requested to
55-include the headings in any compilation or publication containing this act.
56-SECTION 4. This act takes effect July 1, 2025, the public welfare requiring it, and applies to
57-acts committed on or after that date.
